    To facilitate the discharge of its duties inconnection with the election process, anumber of laws and regulations have

    been enacted.These laws and regulations not only give

    the Election Commission its mandate but

    also serve to guide the political parties,the candidates and their agents theframework under which they have tooperate.

    Part 1 - Preliminary

    Definitions of some of terms used inelections

    Eg:

    "candidate" means a person who isnominated in accordance with anyregulations made under this Act as a

    candidate for an election.

    Part 2- Supervisions ofelection

    The Election Commission may, subject toArticle 115 (1) of the Constitution,appoint :

    Secretary and such number of DeputySecretaries, Principal Assistant secretariesto the Election Commission as theCommission may consider necessary;

    State Elections Officer and so many DeputyState Elections Officers for each State asthe Commission may consider necessary;

    Returning officer and so many assistantreturnin o icers or each constituenc as

    Part 3- Constituencies

    If there is any delimitation of aconstituency in accordance with theConstitution, the Election Commission

    shall-divide each constituency into polling

    districts;

    assign to each polling district adistinguishing letter or letters or number orboth;

    appoint a place or places at which a polling

    station or stations for the district shall be

    Election offences

    There are a few offences under electionlaw. Most of these pertain to acts whichinduce a voter to cast his ballot for a

    candidate. It is also an offence to usethese actions to induce voters not tocast ballots at all. These offences extendto using third parties as agents to

    commit them:-

    It is an offence to provide food, drinks or

    refreshments with a view to induce

    It is an offence to threaten a person tovote for a candidate or not to vote. In2004 this was extended to include

    "spiritual threats". This was due tothe Islamic Party of Malaysia(PAS)threatening citizens in less developedparts of the country with eternal

    damnation if they did not vote for thePAS and that a vote for them would berewarded by God.

    It is technically an offence to providetransportation to a voting centre.However, this is not normally enforced as

    all parties do this to some degree. It is afurther offence to use a vehicle that isnormally rented out (such as a taxi orhired bus) to provide such transportation.

    The only exception to this is that it isallowed to provide for the crossingof rivers. No passengers of any vehiclecan be forced to alight within 50 yards

    Elections (Postal Voting)Regulations 2003

    These Regulations come into operationon 16 June 2003

    Forms of postal ballot papers.

    The ballot papers to be sent to postalvoters shall be in the same form as, andindistinguishable from, the ballot papersdelivered to other voters.

    Persons entitled to vote as postal voter:-

    an absent voter;

    a person certified by the Election

    ELECTIONS REGISTRATIONS

    Why You Need To Register.

    It is the right of every qualified citizen toelect the government of their choice to

    govern the country by electing theirrepresentatives to represents them in theHouse of Representatives and the StateLegislative Assemblies.

    You can vote for a representative of yourchoice during the general election or a by-election as an elector.

    You will not be allowed to vote if your nameis not listed in the electoral roll.

    Types of Registration. The EC has 2types of registration and they are:

    New Registration. The EC receives

    applications from citizens who apply toregister as an elector for the first time.

    Registering Change of Address andthereby Polling Centre.

    Types of Electors. According to theelection laws, the EC can register 2 types

    of electors:

    Where to Register. If you are aqualified citizen but have not yetregistered as an elector or if you are aregistered elector who wish to registeryour new residential address, you can dothis at the following places:

    Computerized Post offices;

    EC offices;

    With representatives appointed by the EC atgovernment agencies;

    With representatives from political parties

    How to Register. To register asa normal elector, you need to:

    come personally to any of the registration

    centre;One cannot register on behalf of

    another person.

    produce your MyKad to the EC staff on dutywho will fill the registration form for you;

    check your particulars in the completedform that is given to you by the EC staff

    before you sign the form;
