CONDIZIONI GENERALI DI VENDITA

1) GARANZIA - La ns. garanzia ha la durata di anni unodalla data di fatturazione del prodotto. Essa limitataesclusivamente alla riparazione o alla sostituzione gra-tuita dei pezzi da noi riconosciuti come difettosi ed il re-clamo non potr mai dar luogo allannullamento od allariduzione delle ordinazioni da parte del committente e tan-to meno alla corresponsione di indennizzi di sorta da par-te ns. Il materiale da riparare in garanzia o comunquesoggetto ad anomalie, sar da noi ritirato solo se ci per-verr in porto franco e sar reso al cliente in porto asse-gnato. La ns. garanzia decade se i pezzi resi come difet-tosi sono stati comunque manomessi o riparati. Per ma-nomissione si intende anche lapplicazione del motorefuori dallambito e dalla sede della ns. Societ. La ns.garanzia non copre danni o difetti dovuti ad agenti ester-

ni, deficienza di manutenzione, sovraccarico, lubrificanteinadatto, scelta inesatta del tipo, errore di montaggio edanni derivanti in seguito a trasporto da parte del com-mittente o trasportatore designato, essendo la spedizio-ne sempre a spese e rischio del committente.

2) TRASPORTO - Ad ogni effetto, anche di legge, la mer-ce si ritiene accettata dal cliente (e consegnata) alluscitadalla ns. sede o magazzini. Il trasporto della merce si in-tende sempre per contro, rischio e pericolo dellacquiren-

te anche se la merce venduta franco destino e se iltrasporto viene effettuato con mezzi della ditta venditricee condotti da persona incaricata dalla medesima.

3) PREZZI - La ns. Societ si riserva di modificare in qual-siasi momento le proprie quotazioni (anche se conferma-te) se ci si rendesse necessario in conseguenza a mu-tevoli condizioni di mercato o di produzione. Il listino prezzisi riferisce a merce franco ns. stabilimento, escluso im-ballo ed ogni eventuale altra spesa.

4) RECLAMI - convenuto espressamente che eventua-li reclami o contestazioni da farsi, a pena di nullit; sem-pre in forma scritta ed entro il termini di legge non dannocomunque diritto allacquirente di sospendere o ritardarei pagamenti. Non si accettano addebiti per risarcimentodi danni a cose e persone o ritardi di consegna. Se entro8 gg. Dal ricevimento della ns. conferma dordine non ciperverr alcuna contestazione, la stessa si intender ac-cettata in tutte le sue pari.

5) INTERESSI - Resta espressamente convenuto che gliinteressi verranno fissati ed accettati, in ogni sede di ri-tardato pagamento, secondo le condizioni medie di tassoapplicato dagli Istituti Bancari alla Societ venditrice inquel momento.

6) RISERVA DI PROPRIET - La merce viene vendutacon riserva di propriet finch non sar effettuato il paga-

1) GUARANTEE - Our guarantee expires after oneyear from invoice date of the product. It only coversthe replacement or repair free of charge of the de-

fective units or parts provided that we admit thatsaid faults or defects are to be ascribed to manu-facturing processes. The customer does not haveto feel entitled to cancel or reduce the outstandingorders because of defective material previously

supplied. We will not be responsible for the paymentof any charges related to goods to be replaced orrepaired under guarantee. Returns of material willonly be accepted if both back and forth transportcharges willbe covered by the customer. Our guar-

antee becomes completely null and void if units re-sult altered or repaired. For alteration it is included

also the application of the motor out of the ambitand circle of our Society. Our guarantee does not

cover defects or faults which would be attributed toexternal factors, insufficient maintenance, overload,inadequate lubrication, unproper selection, mount-ing errors or shipping damages being shipmentrisks and expenses on behalf of the customer.

2) SHIPMENT - Material is considered accepted bythe customer once it leaves our warehouse: Ship-

ment of goods is considered at buyers risk even ifshipment is effected free domicile of customer or

through shippers means of tranports or forward-ing agents appointed by the shipper.

3) PRICES - Our Company reserve the right to modify

their own quotation (although confirmed) if it is nec-essary because of the unconstant conditions ofmarket and production. The price list refers to ex-works prices. Not including packing and any otheradditional costs.

4) COMPLAINTS - Complaints for defective material

must be effected in writing and within the legal termsor they will be considered null. In case of complaintsthe buyer is not anyhow entitled to stop or delay pay-ments. Debit notes for refounds of damages to ob-jects or persons as well as deliveries are not ac-

cepted. Any claims should be notified within 8 daysfrom receipt of our order confirmation, otherwise itwill be considered as accepted in all its parts.

5) INTERESTS - It is understood that interests haveto be agreed and accepted, in occasion of late pay-

ments, according to the current average terms, ap-plied by the Shippers blanks.

6) CONDITIONAL SALES - We reserve the right ofproperty on goods sold until the whole payment has
