MPSJtunggu nasihat peguam:ACinan J SUBANG JAYA - Maj- lis Perbandaran Subang Jaya (MPSJ) kini dalam proses perbincangan mendapatkan pandangan peguam mereka sama ada mahu meruntuh- kan kemudahan awam yang dibina sebuah syarikat pen- giklanan selepas mahkamah menolak permohonan injuk- si syarikat terbabit. Ismail berkata, Majlisjuga tidak mempunyai kuasamemberhentikan kerja yangdijalankan tetapi apa yang bo-leh dibuat adalah menasmat-kan mereka membersilikan

"Mereka juga dinasmat-kan membuat papan tandadan juga menitikberatkan ke-selamatan di tapak. Kerja-ker-ja dijalankan bukanlah tidakmendapat kebenaran tetapiada sedildt masalah komuni-

ya (MPSJ) menasihatkansyarikat kontraktor di ka-wasannya supaya mem-buat permohonan terlebihdulu sebelum menjahmkankerja bagi mengelakkantindakan tegas termasukpemberhentian operasiserta -merta.

Pengarah Kejuruteraan-nya, Ismail Shafie berkata,syarat ini bagi menjaminkeselamatan masyarakatyang melalui kawasanpembangunan berikutanpelbagai bahaya menanti,kerana ada sesetengah me-reka tidak mengikut pro-sedur ditetapkan.

Q.:Under what law are the guidelines providedfor?A: The preparation of the planning guidelines arein .line with Section 26 (1) of the Town andCountry Planning Act 1976 (Act 172), whichrequires the Town and Country Planning director-general to formulate and advise the governmenton matters concerning town and country plan-ning and the use and development of lands inPeninsular Malaysia.

For the guidelines on guarded neighbourhood,no specific law governs its operation. Furthermore,local councils have no authority to approve theapplication in setting up the schemes, which hadtaken form in an ad hoc manner.

Q.: Would the local councils be held liableshould any untoward incidents happen as aresult of the gated community and guardedneighbourhood schemes?A: Consideringthe erecting of structures is underthe purview and responsibilityof the gated com-munities and residents associations, and theseactionsare voluntary, the localcouncilscannot belegallyblamed for any untoward incidents in bothgated communities and guarded neighbour-hoods.

Q; Some feel that the guidelines are inconsist-ent with the existing laws (Street, Drainage andBuilding Act 1974 and Road Transport Act1987) as clauses in these acts prohibit any formof restriction of access on roads, while theguidelines for guarded neighbourhood allowtemporary obstacles, such as cones, securitysiguboards and manual boom gates, as long asthe locations are stationed by a guard.A: The issue has been debated at length byCabinetandNCLGmembers,andthe decisiontoallow temporary obstacles was made after con-sidering opinions and suggestions from stake-holders includinglocalcouncils,residents associ-ations and the police.

The temporary barrier shall only be allowed ifthere is a 24-hour security guard to control thetemporary, non-stationary and non-dangerousobstacles.This does not contradict with the RoadTransport Act 1987, which prohibits dangerousobstacles. Furthermore, the guidelines also statethat a temporary obstaclecan only be consideredby the local authority on a case-by-case basis. Ifother residents disagree, the localauthority maydecline the installation of such obstacles.

Q.: The guidelines imply that every entry-exitpoint must have at least a guard (as no perma-nent obstacle is allowed) but housing estates inthe Klang Valley tend to have many entry-exitpoints. It would be impractical to place a guardat every location.A: Firstly, the NCLG has made a decision thatthese guidelines are only applicable to newguarded neighbourhood schemes, and not theexisting schemes which are often unplanned andthus not suitable for operation as a guardedneighbourhood.

Secondly, the clause about temporary physicalobstacle is only an option, and not a condition.The residents associations can opt to operate theguarded neighbourhood through patrolling andother surveillance method without having to sta-tion guards at every entry-exit point. '

Q.:If the guards have no authority to deny any-one from entering the neighbourhood, howwill the guarded neighbourhood scheme beeffective at all?A: This aspect has also been debated at length atthe ministry level as well as the Home AffairsMinistry and the police. Residents operating theguarded neighbourhood schemes should beaware that only the police and other legally des-ignated personnel have the authority to stop, seekidentification cards or investigate people. Securityguards employed by residents have no power toseek identification or stop anyone from entering.

Moreover, from the perspective ofland owner-ship, the guarded neighbourhood scheme is just anormal housing scheme with individual landtitles, unlike gated community which is plannedas a private property.

Even without stopping or seeking identifica-tion, the guards can be proactive by familiarising

themselves with local residents and the inventoryof residen,ts' vehicles so that potential intruderscan be recognised and monitored. The guardedneighbourhood is just a loose concept to detercriminal activities. After all, guarded neighbour-hoods are an "afterthought" ad hoc action, unlikegated communities.

Q; Does majority mean 51%? Wouldn't that betoo small a difference?A: Mathematically, majority means 51%. In poli-tics, two-thirds majority is often used. The spiritof this prescription is that it should be both fairand realistic.

Selangor has imposed an 80% consent require-ment and initially in Marchr the ministry hadproposed a 100% consent requirement beforeoperating the guarded neighbourhood. Followingthis, the ministry has received many responsesand complaints from the public and media sayingthat this regulation is not logical because it is dif-ficult to get 100% agreement from the residents.There is no law that prohibits a house owner, or agroup of house owners, from appointing securityguards to oversee their houses. With public wel-fare and public rights in mind, the guidelines haveclearly stated the condition that the majority rulewould only apply with undue force or pressure onthose residents who do not wish to pay for secu-rity services. In other words, those who do notwish to be part of the scheme are not obliged topay for the expenses.

Q.:Some commented that the need to apply forTemporary Occupation Licence (TOL) for per-manent structures on the road shoulder makesit difficult for those who genuinely need theguarded neighbourhood scheme.

SUBSCRIPTIONto security schemes in residentialareas often cause dispute among paying and non-paying residents.

While those who disagree with the schemesmaintain that they have the freedom of choice,the rest think the former are taking advantage ofthose who contribute to the monthly fees.

A resident in Bukit Rahman Putra 7, SungaiBuloh, who stopped subscribing to the securityservices, was unhappy that the residents.associa-tion put up two banners that read "Do not live onthe charity of your neighbour. Please pay yourshare to protect your family".

"No one can insult or humiliate us. We haveequal rights to stay here without prejudice, shameand fear as the rest of the paying residents," shesaid.

The resident spoke strongly against the actionof putting up the tri-lingual banners at theguardhouse to embarrass the non-paying resi-dents.

"It does not promote harmony within theneighbourhood and I certainly do not live on myneighbours' charity,"she said.

The resident said she opted to drop out from

the scheme as she was dissatisfied with the serv-ices provided by the security company.

She pointed out that a neighbouring residentialarea, Bukit Rahman Putra 6, also has a similarbanner put up near its guardhouse.

When contacted, residents association chair-man K.S. Ooi said the intention of putting upthe banners was not to embarrass the resi-dents and was not targeted at anyone in par-ticular.

"It's a general banner to create awareness andencourage the residents to join the securityscheme," he said.

He added that the fees charged by the securitycompanies increased when the governmentstopped them from employing foreign guards.

'The residents association faced the plightwhen there is insufficient subscription to pay forthe fees.

"Some residents take the security services forgranted as it is paid for by other residents," hesaid.

Ooi said he was upset over the,'sole complaintby the resident.

He added that out of the 348 houses, about 220were participating members.

"Last year, two or three burglaries happenedfortnightly. We are having the security service for

the benefit of all," he said.Over in Taman Mutiara Puchong, the residents

association face a problem of non-paying mem-bers and visitors hitting the boom gates to enteror exit the neighbourhood.

The association has to fork out RM600 everytime the boom gate was hit, and it has happenedmore than 10 times. .

Gerard Lim, a association committee member,said they had lodged police report and even tookthe matter to the magistrate court.

In a residents association meeting, it wasdecided that the signs that read "You BangYou Pay" to be displayed on the boom gates tostop the stubborn ones from hitting the baragain.

The method has proven effective as no otherincident happened since then.

"The paying resident5 are given access cards toraise the automatic boom gates, while non-pay-ing residents and visitors have to register at theguardhouse every time they want to enter theneighbourhood.

"It is not fair to 80%of the residents to pay forthe non-paying ones.

"Our guards take care of the common area,such as the field, where children gather and play,"Lim said.

This is also to avoid the guardhouses frombeing demolished by the land office, which hasthe legal right to demolish buildings which arenot in line with the National Land Code.

Q; The guidelines forbid the guarded neigh-bourhood scheme to be implemented inareas with public facilities but almost every .neighbourhood in Subang Jaya and PetalingJaya has common facilities.A: As explained, the NCLGhas decided that theguidelines approved i5 only applicable to newguarded neighbourhood schemes. It is not theintention of the guidelines that all neighbour-hoods be implemented with the scheme.

Only neighbourhoods that are planned to bemutually exclusive and have communal facili-ties like those of gated community are practi-cal because they should not have public facili-ties in their premises. It should also be notedthat the majority of the housing schemes out-side the Klang Valley do not have boom gatesand guardhouses, but only security patrollingin and around the housing schemes. The ministry has also conduct-ed a special study to obtain responses from thepublic, involving 450 respondents in severallocal authority areas in the Klang Valley andPenang in formulating the guidelines.
