warga Serian tetapi juga Bank Simpanan Nasional di tempat-tempat yang lain. Bagi lokasi-lokasi kritikal bukan sahaja di Serian tetapi juga di kawasan luar bandar di daerah-daerah lain, BSN akan mengkaji dan mempertimbangkan untuk menambah kakitangan mereka dan juga mungkin lokasi-lokasi yang lebih sesuai, dan pejabat yang lebih selesa untuk warga kawasan luar bandar untuk mendapatkan perkhidmatan yang terbaik daripada BSN. Terima kasih. YB Encik John Anak Ilus: Terima kasih, Timbalan Menteri. So I have one (1) additional question untuk memudahkan pelbagai urusan rakyat khususnya di kawasan luar bandar be it in Serian or elsewhere, apakah ada perancangan Kerajaan untuk mewujudkan ataupun membina baru pusat bersepadu untuk perkhidmatan-perkhidmatan seperti yang disebutkan tadi? Sekian, terima kasih. Menteri Muda Hal Ehwal Korporat (YB Encik Abdullah Bin Haji Saidol): Perkara yang dibangkit oleh Yang Berhormat Bukit Semuja ialah sesuatu yang equally, a concern to other YBs di kawasan, terutama sekali di kawasan pedalaman daerah-daerah lain yang banyak menggunakan perkhidmatan BSN dan juga pejabat pos untuk pelbagai bayaran dan sebagainya. Cadangan Yang Berhormat Bukit Semuja amatlah baik dan akan diberi perhatian yang sewajarnya. Tapi buat sementara ini tiada perancangan khusus untuk membina satu pusat integrated untuk kedua pejabat pos dan Bank Simpanan Nasional. Walau bagaimanapun, perkhidmatan pejabat pos akan dirancang untuk ditempatkan di kaunter perkhidmatan di kawasan luar bandar melalui integrated ”Multi Service Counter” ataupun Kaunter Pelbagai Perkhidmatan Bersepadu yang saya rasa akan memberi keselesaan kepada ramai warga luar bandar untuk mendapat perkhidmatan yang terbaik daripada dua agensi ini. Sistem Tagang di Sungai Tisa, Yong Kapit YB Encik Jefferson Jamit Anak Unyat: Terima kasih, Tuan Speaker. Soalan saya nombor dua. (2) YB Encik Jefferson Jamit Anak Unyat (N.63 Bukit Goram) bertanya kepada Menteri Pemodenan Pertanian, Tanah Adat dan Pembangunan Wilayah: Adakah Jabatan Pertanian bercadang hendak mengaktifkan semula Sistem Tagang di Sungai Tisa, Yong, Kapit, memandangkan air sungai tersebut telah pulih seperti sediakala? Menteri Muda Pertanian (YB Dr Haji Abdul Rahman Bin Haji Ismail): Terima kasih, Tuan Speaker dan terima kasih kepada Ahli Yang Berhormat bagi Bukit Goram di atas minat yang ditunjukkan untuk mengaktifkan semula sistem tagang di Sungai Tisa, Yong, Kapit.

Untuk makluman Ahli Yang Berhormat, Jabatan Pertanian telah membuat tinjauan dan kajian di sungai tersebut dan mendapati setakat ini kualiti air di situ masih belum lagi sesuai untuk melaksanakan Projek Tagang.

Walau bagaimanapun Jabatan akan terus membuat pemantauan dan tinjauan dari semasa ke semasa dan apabila didapati ianya sesuai maka Kementerian akan mengaktifkan semula Sistem Tagang di sungai tersebut dengan kerjasama penduduk setempat. Terima kasih.

YB Encik Jefferson Jamit Anak Unyat: Terima kasih, Tuan Speaker. Terima kasih, Menteri Muda. Saya ada dua (2) soalan tambahan:

(a) Berapakah Projek Tagang yang telah dilaksanakan oleh Kerajaan? (b) Apakah faktor utama yang akan menentukan kejayaan sesebuah Projek Tagang

dan di manakah projek yang telah berjaya dilaksanakan di Sarawak? Terima kasih. Menteri Muda Pertanian (YB Dr Haji Abdul Rahman Bin Haji Ismail): Terima kasih, Ahli Yang Berhormat bagi Bukit Goram. Sistem Tagang merupakan satu sistem diwujudkan bagi tujuan pemeliharaan ataupun conservation dan pemuliharaan rehabilitation sungai-sungai di Negeri Sarawak. Setakat ini sebanyak 93 Projek Tagang telahpun dilaksanakan di seluruh Negeri Sarawak. Antara 93 projek tersebut terdapat 11 buah telahpun menunjukkan kejayaan yang begitu memberangsangkan dan antara kawasan contoh yang boleh diikuti adalah di tagang Kampung Terbat Mawang Bahagian Serian dan tagang di Long Lidung Lawas di Bahagian Limbang.

Untuk menjawab soalan yang kedua, untuk makluman Ahli Yang Berhormat bagi Bukit Goram, kejayaan Sistem Tagang banyak bergantung kepada faktor kerjasama dan persefahaman dalam kalangan ahli jawatankuasa tagang dengan penduduk kampung setempat. Selain daripada itu, penguatkuasaan peraturan tempatan oleh penduduk kampung juga menentukan persekitaran kawasan tagang sentiasa dijaga dan dipelihara. Dengan kejayaan Sistem Tagang tersebut ianya boleh menambah sumber pendapatan bagi penduduk setempat dengan mengambil ikan-ikan secara terkawal dan juga boleh dijadikan sebagai program eko pelancongan untuk menarik lebih ramai pelancong ke kawasan tagang tersebut. Jenayah Sosial Di Kawasan Luar Bandar

(3) YB Dato’ Murshid Diraja Dr Juanda Bin Jaya bertanya kepada Menteri Kebajikan, Kesejahteraan Komuniti, Wanita, Keluarga dan Pembangunan Kanak-Kanak: Apakah tindakan pencegahan Kerajaan terhadap jenayah sosial yang semakin menjadi-jadi di kawasan luar bandar seperti dadah dan sebagainya, memandangkan jumlah penempatan Pegawai Kerajaan dan Polis amat rendah dan ada yang ditempatkan terlalu lama sehingga mungkin menjejaskan kecekapan tindakan penguatkuasaan?

Menteri Muda Kesejahteraan Komuniti (YB Datuk Francis Harden Anak Hollis): Terima kasih, Tuan Speaker. Untuk makluman Ahli Yang Berhormat bagi Jemoreng, sehubungan dengan tindakan PDRM dalam usaha-usaha pembanterasan dadah di Sarawak memang tidak dapat dinafikan melalui penempatan elemen narkotik di beberapa buah daerah di Negeri Sarawak. Sebelum ini PDRM Sarawak hanya mempunyai 15 daerah penempatan elemen narkotik dengan penambahan tiga (3) daerah lagi iaitu Belaga, satu (1) Sarjan dan dua (2) anggota; Marudi, satu (1) Sarjan; dan Lundu satu (1) Inspektor, satu (1) Sarjan dan dua (2) anggota pada tahun 2017. Pada tahun 2018, PDRM telah menambah lagi empat (4) daerah lagi penempatan elemen narkotik iaitu Matu Daro, Simunjan, Meradong dan Julau melalui arahan penempatan rujukan JSJN 106/4 bertarikh 19 Jun 2018. Tindakan tersebut terpaksa diambil secara berperingkat berdasarkan kepada kemampuan semasa PDRM. Sepanjang Januari hingga Jun 2018, seramai 301 orang pengedar dadah telah berjaya

ditangkap oleh Jabatan Siasatan Jenayah Narkotik PDRM berbanding dengan 498 orang pada tahun 2017 iaitu peningkatan 60.44% bagi tempoh yang sama tahun yang lepas dari Januari hingga Jun 2017.

Di bawah Undang-undang Pencegahan Akta Dadah Berbahaya, Langkah-Langkah Pencegahan Khas Tahun 1985, PDRM juga telah berjaya menangkap 24 orang antara Januari hingga Jun tahun ini berbanding dengan 46 orang tahun 2017 iaitu peningkatan sebanyak 52.17% bagi tempoh yang sama tahun lepas dari Januari hingga Jun 2017. PDRM juga mengambil tindakan tegas dengan menyita harta-harta pengedar-pengedar dadah yang telah ditangkap iaitu sebanyak RM1,083,890.63 juta pada tahun 2018, kerana penyitaan harta pengedar ini adalah amat penting bagi memastikan aktiviti pengedaran dadah terus dihapuskan dengan melemahkan sumber kewangan pengedar dadah. Selain itu, berbanding dengan peratusan keberkesanan penyampaian tindakan memerangi dadah keseluruhan kontinjen PDRM di Malaysia, PDRM Sarawak buat pertama kalinya pada tahun 2017 berada pada kedudukan pertama bagi kategori bekalan. Pertama, bagi kategori Akta Dadah Berbahaya, Langkah-langkah Pencegahan Khas 1985 Tangkapan Pencegahan Terhadap Pengedar Dadah dan yang kedua, bagi kategori Sitaan Harta Pengedar Dadah. Hal ini sekaligus menunjukkan peningkatan usaha yang dilakukan oleh PDRM dalam membanteras dadah. YB Dato’ Murshid Diraja Dr Juanda Bin Jaya: (Soalan Tambahan) Terima kasih kepada Yang Berhormat Menteri Muda atas penjelasan. Tuan Speaker, saya ada dua soalan tambahan:

(a) Bagaimanakah operasi pencegahan jenayah sosial dijalankan di kawasan luar bandar yang terlalu luas saiznya serta sukar pengangkutan dan pergerakan?

(b) Bagaimana pula dengan proses rotation pertukaran kakitangan penguat kuasa dan pencegahan jenayah daripada kalangan polis dan petugas kebajikan yang membantu menangani isu sosial luar bandar seperti dadah,incest, sabung ayam dan sebagainya memandangkan ada khabar angin yang menyatakan ada yang sudah berada di balai-balai polis untuk tempoh yang agak lama sehingga sebahagian jenayah seperti dadah seolah-olah dilindungi sehingga menyebabkan penagih bertambah dan pengedaran dadah atau barang terlarang kelihatan agak bebas berleluasa.

Untuk makluman Ahli Yang Berhormat bagi Jemoreng, operasi pencegahan jenayah sosial di kawasan luar bandar yang mempunyai saiz yang luas serta kemudahan pengangkutan terhad memang sukar. Oleh itu komuniti setempat perlu dipastikan untuk menangani isu-isu sosial yang berlaku di kawasan mereka. Sehubungan itu, peranan Jawatankuasa Kemajuan dan Keselamatan Kampung (JKKK) perlu dimantapkan agar dapat menyalurkan maklumat kepada agensi penguatkuasa untuk tindakan segera mereka. Selain itu, JKKK yang jauh daripada pihak penguatkuasaan perlu mula menganjurkan rondaan bersama penduduk kampung, menetapkan peraturan dan mengadakan forum kesedaran dan evokasi untuk penduduk kampung bagi menangani isu-isu sosial yang dihadapi.

Jadi untuk membuat laporan kepada pihak polis, maklumat dan aduan boleh juga dibuat melalui aplikasi Volunteer Smartphone Patron (VSP) yang boleh dimuat turun daripada internet dan playstore selain membuat laporan melalui telefon ke balai polis yang berhampiran. Setiap sekolah juga dipantau oleh pegawai perhubungan polis sekolah. Jadi maka pihak PIBG dan sekolah perlu menjalinkan hubungan strategik dengan pegawai polis berkenaan dengan menyalurkan maklumat dan input tentang isu-isu jenayah sosial yang

berlaku di kawasan setempat. Amalan rondaan atau rotation Kerajaan atau rotation kerja memang berlaku dalam agensi-agensi penguatkuasaan. Walau bagaimanapun, pertukaran keluar pegawai-pegawai penguatkuasaan selalunya berlaku jika mereka dinaik pangkat atau mempunyai masalah disiplin yang telah disebutkan oleh Yang Berhormat tadi yang melibatkan integriti yang jelas dan melaporkan mengikut Perintah-Perintah Am atau General Orders semasa yang berkuatkuasa.

Jadi oleh itu, tindakan berbentuk bukan penguatkuasaan dengan memperkasakan komuniti kita jadi agar menyalurkan maklumat tentang isu-isu yang melibatkan integriti anggota penguatkuasaan di peringkat akar umbi perlu dibuat. (4) YB Encik Yussibnosh Balo bertanya kepada Ketua Menteri: Berapakah bilangan Majistret di Mahkamah Bumiputera Sarawak dan berapakah jumlah kes keseluruhan yang belum diselesaikan? Menteri Muda Undang-undang Adat dan Bumiputera (YB Datuk John Sikie anak Tayai): Terima kasih, Tuan Speaker. Terima kasih kepada Yang Berhormat Tellian, nanti saya jawab pantun. Untk makluman Ahli Yang Berhormat dari Tellian, bilangan majistret di Mahkamah Bumiputera Sarawak pada masa ini adalah seramai 19 orang yang dilantik sepenuh masa secara kontrak. Majistret ini terdiri daripada seorang Presiden, Mahkamah Rayuan Bumiputera; dua (2) orang majistret, Mahkamah Bumiputera Residen dan 16 orang majistret, Mahkamah Bumiputera Daerah. Tanggungjawab utama majistret ini adalah untuk mengendalikan kes-kes sivil seperti kes pertikaian tanah adat Bumiputera dan kes-kes permohonan untuk dikenali sebagai komuniti bumiputera. Selain daripada itu, Mahkamah Bumiputera Sarawak juga dikendalikan oleh seramai 52 orang majistret Ex-Officio yang terdiri daripada 12 orang Residen Bahagian dan 40 orang pegawai Daerah. Manakala kes-kes pelanggaran Adat, Mahkamah Bumiputera Sarawak dikendalikan oleh 2,546 orang Ketua Kaum, 390 orang Penghulu dan 87 orang Pemanca dan Temenggong. Jumlah keseluruhan kes di bawah bidang kuasa Mahkamah Bumiputera Sarawak setakat 30 Mei 2018 adalah sebanyak 11,003 kes dimana sebanyak 5,962 kes adalah yang belum dapat diselesaikan. (a) Dari kes sivil yang dibicarakan apakah jenis ataupun bentuk kes yang telah berdaftar ataupun boleh didaftarkan di Mahkamah Bumiputera?

(b) Kita lihat tadi bahawa 11,003 kes yang masih belum diselesaikan. Apakah langkah-langkah untuk menyelesaikan kes-kes yang tertunggak ini? Terima kasih.

Menteri Muda Undang-undang Adat dan Bumiputera (YB Datuk John Sikie anak Tayai): Terima kasih, Yang Berhormat dari Tellian. Untuk menjawab soalan pertama, kes tuntutan sivil yang didaftar oleh Majistret Mahkamah Bumiputera adalah District Native Court, Mahkamah Bumiputera Residen iaitu Resident Native Court dan Presiden Mahkamah Rayuan Bumiputera iaitu Native Court of Appeal. Permohonan untuk dikenali sebagai Komuniti Bumiputera yang didaftar oleh majistret maka ini dikendalikan oleh Mahkamah Bumiputera Residen dan kes pelanggaran adat yang didengar di Mahkamah Ketua Kampung (Headman‟s Court), Mahkamah Ketua Masyarakat (Chief‟s Court) dan Mahkamah Atasan Ketua Masyarakat (Chief‟s Superior Court) .

Jadi untuk menjawab soalan kedua, soalan tambahan sebentar tadi untuk pengetahuan Yang Berhormat dari Tellian, penganjuran yang kerap berkaitan dengan program atau latihan capacity building adalah diadakan oleh Mahkamah Bumiputera Sarawak untuk memperkasakan ilmu pegawai-pegawai dan kakitangan-kakitangan yang terlibat dalam urusan serta prosedur mahkamah sejak tahun 2010.

Peringatan kepastian pegawai mahkamah atau majistret akan mempercepatkan dan

melancarkan lagi urusan mahkamah. Pada tahun 2017, sebanyak 17 bengkel serta kursus telah diadakan untuk kumpulan sasaran ini dengan kehadiran seramai 1,525 orang peserta. Pada tahun 2018 sebanyak 14 bengkel berserta kursus telah dan akan diadakan untuk kumpulan sasaran ini yang dijangka melibatkan 1,060 peserta. Sekian. Kawasan Gunung Ngeli Sebagai Pusat Pelancongan

(5) YB Encik Awla Bin Dris bertanya kepada Menteri Pelancongan, Kesenian, Kebudayaan, Belia dan Sukan: Apakah inisiatif pihak Kerajaan untuk membangunkan kawasan Gunung Ngeli sebagai pusat pelancongan dan tempat bersejarah di Negeri Sarawak? Cadangan peningkatan kemudahan pelancongan Gunung Ngeli telah dikemukakan dalam pembangunan separuh penggal Rancangan Malaysia ke-11. Walau bagaimanapun, cadangan tersebut tidak diluluskan dan ianya boleh dipertimbangkan untuk dicadangkan semula bagi Rancangan Malaysia ke-12.

Majlis Daerah Simunjan telah mengambil beberapa inisiatif untuk membangunkan kawasan ini iaitu dengan mewujudkan plan induk lanskap untuk Daerah Simunjan. Antara cadangan kerja penambaikan yang telah dikenalpasti ialah:

(a) Membuat „nature trail‟ iaitu untuk menikmati keindahan keadaan semula jadi di kawasan Gunung Ngeli;

(b) Mewujudkan Taman Herba; (c) Pengekalan spesis tumbuhan semula jadi seperti pokok Tongkat Ali, Pokok Kayu

Hujan Panas, tumbuhan herba, orkid liar dan sebagainya; dan (d) Membangunkan pondok rehat dan gazebo.

Terbinanya jambatan Batang Sadong, telah memberi kemudahan kepada

pengunjung untuk melawat ke Daerah Simunjan dan dengan ini secara tidak langsung dapat memberi peluang kepada pihak yang berkenaan seperti Majlis Daerah dan juga Pejabat Daerah Simunjan untuk menggiatkan promosi terhadap gunung ini. YB Encik Awla Bin Dris: (Soalan Tambahan). Saya ada dua (2) soalan tambahan iaitu:

(a) Apakah latar belakang Gunung Ngeli? (b) Dari segi industri pelancongan, apakah pontensi penyertaan oleh masyarakat

tempatan? Menteri Muda Pelancongan, Kesenian dan Kebudayaan (YB Datuk Lee Kim Shin): Tuan Speaker. Terima kasih, Ahli Yang Berhormat bagi Simunjan atas dua (2) soalan tambahan itu. Soalan tambahan pertama nampaknya kalau bagi jawapan sangat panjang sekali. Tetapi saya akan bagi jawapan secara ringkas iaitu Gunung Ngeli merupakan bekas kawasan perlombongan arang batu seawal tahun 1850 semasa Era Pemerintahan Brooke.

Selain daripada itu, terdapat juga sebuah boiler iaitu kepala keretapi yang kini ditempatkan di kawasan Gunung Ngeli New Service Centre dan masih dalam keadaan baik. Di samping itu, kawasan ini pernah dijadikan tapak kajian oleh pakar sejarah alam semula jadi yang terkenal iaitu Sir Alfred Russell Wallace seperti dilaporkan di dalam buku The Malay Archipelago.

Untuk makluman Ahli Yang Berhormat bagi Simunjan, kalau ingin mendapat butir-butir lanjut, boleh juga didapati di Sarawak Gazet bertarikh 30 April 1966 dan 31 Mei 1970. Berhubung dengan soalan yang kedua, iaitu potensi industri pelancongan masyarakat tempatan akan meyertai. Terdapat dua industri yang mungkin boleh kita majukan iaitu:

(a) Industri Homestay; dan (b) Pembangunan Kraftangan

Kedua-dua industri ini mempunyai potensi yang tinggi untuk dimajukan. Buat masa ini

tiada homestay di Simunjan dan homestay yang terdekat terletak di Sadong Jaya. Memandangkan Gunung Ngeli juga indah di samping mempunyai nilai sejarah pelombongan arang batu yang menarik, boleh dijadikan sebagai salah satu daripada bahan promosi bagi Gunung Ngeli. Selain daripada itu, aktiviti mendaki atau rekreasi juga boleh dianjurkan untuk menarik lebih ramai pelawat datang ke kawasan ini dan sekali gus dapat membangunkan industri homestay dan kraftangan bagi kawasan ini dan juga untuk Ahli Yang Berhormat

Simunjan, Tourism Task Group di bawah Pejabat Residen Samarahan telah juga merancang untuk mengadakan Larian Gunung Ngeli bulan Ogos tahun ini. Program seperti larian merupakan acara sukan pelancongan atau Sport Tourism. Ia juga merupakan usaha untuk memperkenal dan mempromosikan Gunung Ngeli sebagai tempat tarikan pelancong. Menaik Taraf Transformer Bekalan Elektrik Luar Bandar

(6) YB Dato Ranum Anak Mina bertanya kepada Menteri Utiliti Sarawak: Apakah terdapat sebarang peruntukan daripada pihak Kementerian untuk kerja-kerja menaik taraf Transformer Bekalan Elektrik Luar Bandar yang berkapasiti rendah kepada yang berkapasiti lebih tinggi agar dapat menampung keperluan pihak pengguna? Menteri Muda Elektrik Luar Bandar (YB Dr Haji Abdul Rahman Bin Haji Junaidi): Terima kasih Tuan Speaker. Untuk maklumat Ahli Yang Berhormat bagi N.1 Opar, selama ini peruntukan untuk membina transformer termasuk untuk menaik taraf elektirk yang ada di Sarawak peruntukannya dibiayai oleh Kementerian Kemajuan Luar Bandar Dan Wilayah (KKLW) sebelum ini dan namanya Kementerian Pembanguan Luar Bandar Persekutuan dan peruntukan ini digunakan untuk menaik taraf transformer termasuk juga untuk menyediakan bekalan bagi projek Bekalan Elektrik Luar Bandar (RES) di seluruh negeri Sarawak termasuk di kawasan luar bandar.

Menjawab soalan mengenai usaha meningkatkan kapasiti rendah sesuatu transformer. Tugas untuk memantau bebanan kesemua ini di negeri Sarawak dijalankan oleh pihak Sarawak Energy ataupun Sarawak Energy Berhad khasnya di kawasan luar bandar dan di situ tugasnya dijalankan apabila kapasiti sesebuah transformer itu melebihi tahap 80%, maka pihak Sarawak Energy akan menaik taraf sesebuah transformer tersebut. Tugas ini dijalankan oleh pihak Sarawak Energy bagi pihak Kementerian Pembangunan Luar Bandar untuk meningkatkan kapasiti sesebuah transformer. Terima kasih. Untuk menjawab soalan yang kedua, bagi menaik taraf transformer yang kapasiti 50kva kepada 160kva, kosnya ialah sebanyak RM20,000 bagi sebuah transformer tidak termasuk kos pemasangan. Seandainya dimasukkan kos pemasangannya, jumlah kos keseluruhan untuk menaik taraf transformer tersebut daripada 50kva kepada 160kva adalah sebanyak RM80,000. Terima kasih. (7) YB Dato’ Sri Huang Tiong Sii to ask the Minister for Infrastructure Development and Transportation: Is there any plan to relocate the RC Coastal Wharf at Sungai Nyelong due to the road congestion by heavy vehicles during loading and unloading works? For the information of the Ahli Yang Berhormat for Repok, the project under the title “Proposed New Reinforced Concrete Commercial Wharf at Sungai Nyelong, Sarikei Division” has been submitted under the State funded Mid Term Review of the 11th Malaysia Plan. However, it has not been approved. YB Dato’ Sri Huang Tiong Sii: (Supplementary Question) Thank you, Tuan Speaker and thank you Yang Berhormat Datuk. I have two (2) supplementary questions.

(a) Where is the proposed new site? (b) What are the project proponent and what are the estimated cost?

Thank you. Menteri Muda Pengangkutan (YB Datuk Dr Jerip Anak Susil): Tuan Speaker, thank you for the supplementary questions from the Member for Repok. The expected number of vessels coming to the present wharf average to about eight vessels per month. Which means that, as time goes by, the present wharf will not be able to accommodate new vessels coming in and that will be more unsuitable for the present needs of the vessels. Therefore, the new proposed site that has been proposed is at the Lot 153, Sarikei Land Riverbank Reserve that is just opposite the Sarikei town near the old ferry land and Sungai Nyelong.

Now, plan has been done and the project proponent consisted of soil survey investigation and cost design and it include the construction of the reinforced concrete wharf including the approaches and thirdly, of course there is need to be road furnisher such as street lighting and signages. The propose wharf is about 100 metres long and about 30 metres wide in width and that will cost about RM8 million altogether. Thank you. Kerajaan Negeri telah meluluskan sebidang tanah seluas 12 ekar pada 16 Mei 2017 sebagai tapak bagi pembinaan bangunan pejabat baharu dengan peruntukan sejumlah RM5 juta telah diluluskan di dalam Kajian Separuh Penggal Rancangan Malaysia Ke-11. For the information of Ahli Dewan Undangan Negeri for Batu Danau, let me high lighten the august House first. The number of schools in Sarawak at the moment is 1,454 schools. Out of these, we have 1,264 primary schools and out of all these primary schools, 849 are a low enrolment school which is defined as a school with less than 300 students. And the number of schools that we already plan to merge in Sarawak is 357 schools. This has been our aspiration since the formation of the Ministry of Education in the state of Sarawak. And for the reason that of course number one, we think that the merging of this school will allow us to pull all the resources. The specialise teachers can be placed with the schools. The infrastructure can be rebuilt and can be shared among the students. This will allow the competitiveness among the students and is more cost effective. However, with the new Federal Government we do not know whether this plan will be implemented or not. But it is interesting to take note that by the press conference by the newly appointed Minister of Works, congratulation Minister, he has put an emphasize that in three things. The hospitals, the roads and the schools. And therefore, the State Government are looking forward to work together with the Federal Government to implement the merging of this school because it is very important for the State of Sarawak. Supa-Tule-Manggut dilaksanakan dalam 2 fasa. Fasa Pertama merangkumi komponen seperti tapak untuk komersil (11.3 ekar), dewan komuniti (4.7 ekar), masjid (3 ekar), stesen pertanian (4.7 ekar), rizab kerajaan (7 ekar), sukan serta rekreasi (3.5 ekar) dan jalan termasuk perparitan. Pembinaan jalan dan perparitan telah siap dan diserah kepada pihak berkuasa tempatan pada 4 Julai 2014 untuk tujuan penyelenggaraan. Sehubungan itu, mana-mana permohonan pertapakan bagi tujuan pembangunan komponen-komponen yang disediakan bolehlah dikemukakan keoada Jabatan Tanah dan Survei. Bagi Fasa 2 pula, jumlah RM30 juta telah dipohon dalam Rancangan Malaysia ke-11, yang merangkumi pengambilan balik tanah, kerja ukur, rekabentuk dan pembinaan jalan gravel sepanjang 3.2 kilometer. Walau bagaimanapun, ianya tidak diluluskan. Bagi Projek Service Centre Tanjung Assam Sebemban-Belingan pula, ia juga dilaksanakan secara berfasa. Di bawah fasa 1 pengambilan balik tanah ke atas sebahagian daripada keseluruhan kawasan projek dan pembinaan jalan (termasuk perparitan) sepanjang 1.3 kilometer telah disiapkan. Manakala kerja-kerja yang merangkumi penurapan jalan sepanjang 0.7 kilometer lagi telah ditender pada pertengahan Jun 2018 dan kerja tersebut dijangka akan siap sepenuhnya pada penghujung tahun 2019. a) Kenapa permohonan dan bekalan anak pokok sawit memakan masa yang terlalu lama untuk diluluskan?

b) Apakah tindakan penyelesaian yang dibuat oleh Kerajaan?

Menteri Muda Pembangunan Adat Tanah (YB Datuk Roland Sagah Wee Inn): Terima kasih, Tuan Speaker. Terima kasih kepada Ahli Yang Berhormat. Untuk makluman Ahli Yang Berhormat Lambir, bagi permohonan Skim Bantuan Tanaman Baru Sawit Pekebun Kecil (TBSPK) termasuk bekalan anak benih sawit, kelulusan permohonan adalah bergantung kepada beberapa faktor. Antaranya adalah:-

i. Salah satu (1) kriteria untuk memohon TBSPK adalah pengesahan status pemilikan tanah oleh pihak berkuasa. Di Sarawak kebanyakan permohonan

ii. Tanah yang belum diukur perlu dirujuk kepada pihak berkuasa untuk pengesahan pemilikan dan verifikasi. Proses ini memerlukan masa yang agak lama kerana pihak berkuasa berkaitan perlu membuat pengesahan di lapangan; dan

iii. Pembekalan anak benih sawit diperolehi melalui proses sebut harga/tender daripada pembekal semaian yang berlesen dengan Malaysia Palm Oil Board (MPOB). Ia juga bergantung kepada umur dan bekalan anak benih sawit di kawasan projek berkenaan. Apabila bekalan anak benih sawit tidak mencukupi, maka bekalan anak benih perlu diperolehi daripada tapak semaian dari kawasan lain. Ini juga mengambil masa yang agak lama.

Tuan Speaker, untuk soalan (b), untuk makluman Ahli Yang Berhormat Lambir, bagi

mengatasi masalah tersebut dan untuk mempercepatkan proses verifikasi status pemilikan tanah semua permohonan TBSPK yang menggunakan tanah kategori lima (5) akan dirujuk ke One Stop Committee (OSC) sebelum dihantar kepada Jawatankuasa Pemandu Bantuan Pekebun Kecil (JPBPK) untuk kelulusan.

OSC dianggotai oleh Ministry of Modernisation of Agriculture, Native Land and

Regional Development (MANRED), Jabatan Tanah dan Survei, Jabatan Hutan, Jabatan Bekalan Air Luar Bandar dan Lembaga Sumber Asli dan Alam Sekitar.

Disamping itu, untuk menjamin bekalan anak benih sawit yang mencukupi, MPOB

menggalakkan lebih banyak pengusaha tapak semaian sawit, khasnya, di wilayah utara Sarawak.

Daripada jumlah tersebut, 3,126 permohonan atau 66% dengan keluasan 6,163 hektar atau 60% telah dilaksanakan.

Untuk soalan tambahan yang kedua, Skim TBSPK mempunyai lima (5) komponen

utama iaitu bekalan anak benih sawit, penyediaan kawasan jalan ladang, baja dan racun rumpai dan serangga. Ini keseluruhan bagi sektor skim TBSPK ini adalah RM9,000.00. Kesian juga kawan ini...(Laughter)

LAW REGULATING OIL MINING (OMO) IN SARAWAK

Timbalan Ketua Menteri, Menteri Pembangunan Perindustrian dan Usahawan, Menteri Pembangunan Bandar dan Sumber Asli II (Yang Berhormat Datuk Amar Haji Awang Tengah Bin Ali Hasan): Tuan Speaker, I beg to move that the Oil Mining (Amendment) Bill, 2018 be read the second time.

Tuan Speaker, the proposed Bill is to amend the Oil Mining Ordinance 1958) (Cap. 85) (in short OMO, which is the law relating to oil mining in the State and in the Continental Shelf of Sarawak. The OMO was passed by the Council Negeri in 1958 and came into force on 9th June 1958. It is the law passed before Malaysia Day and by virtue of Section 73 of the Malaysia Act, 1963, OMO continues to have effect in Sarawak and remains as a State Law, being a law that the State Legislature can pass by reason of Item 2(c) of List II (State List) in the Ninth Schedule of the Federal Constitution.

The Bill is presented to update several provisions in OMO and to bring the Ordinance

in line with current practices and operations in the upstream sector of the oil and gas industry. With the amendment, the State will be able to strengthen its regulatory control over the exploration and prospecting for petroleum (which by definition includes “natural gas”) and the mining thereof on land in the State, both onshore and offshore in the Continental Shelf, bearing in mind that the definition of “State land” in Section 2 of the Land Code includes the foreshore and beds of the sea within the boundaries of Sarawak as extended by the Sarawak (Alteration of Boundaries) Order in Council 1954.

Tuan Speaker, the Explanatory Statement to the Bill explains the legal implications of

the various clauses in the Bill, I assume that all Honourable Members have read the Bill and its explanatory statement.

Oil mining in Sarawak began in 1910. Oil and gas are the resources of the State during the time of the Rajahs, during the colonial administration and even after Malaysia Day. Land in Miri District for oil mining was reserved or granted by the 3rd Rajah by his Order XXIX 1921 and subsequently by Mining Lease issued by the Colonial Administration in 1952 to Sarawak Oilfields Limited, a Company owned by the Royal Dutch Shell Company.

The British Government safeguarded Sarawak‟s rights to the oil and gas resources in

the Continental Shelf by the Sarawak (Alteration of Boundaries) Order, 1954 to extend the boundaries of Sarawak to cover the seabed and subsoils in the Continental Shelf without affecting the character of the high seas above the Continental Shelf.

When Parliament passed the Continental Shelf Act 1966 and the Petroleum Mining Act

1966 to regulate mining of petroleum in the Continental Shelf, these Acts were not extended to Sarawak. However, these 2 Acts were made applicable to Sarawak after the 1969 Proclamation of Emergency when in the exercise of emergency powers under Article 150 of the Federal Constitution; the Yang di-Pertuan Agong promulgated the Emergency (Essential Powers) Ordinance No. 10, to extend the said Acts to Sarawak and Sabah.

However, the Oil Mining Ordinance, 1958 was never repealed by the said Emergency

Ordinance No. 10 which ceased to have effect in 2012 as Article 150(7) of the Federal Constitution provides that all laws passed during the Emergency shall cease to have effect 6 months after the Proclamation of Emergency is annulled by Parliament. The said Proclamation of Emergency was annulled by both Houses of Parliament at the end of 2011.

Therefore, as from 2012, the OMO remains the only law that regulates the exploration,

prospecting and mining of petroleum on land in Sarawak, both onshore and offshore. I must state categorically that having regards to Section 8 of the Petroleum

Development Act, 1974, PETRONAS is not exempted from complying with OMO or the Land Code when PETRONAS or its contractors undertake exploration, prospecting and mining for petroleum in Sarawak. The State Government never waived the obligations of PETRONAS and its contractors from complying with our State Laws when undertaking the said upstream activities both onshore and offshore of Sarawak.

Tuan Speaker, the purpose of regulating the upstream activities of PETRONAS and its

contractors is to ensure that their upstream activities comply with our State Laws. These laws are to ensure that the exploitation of the State‟s valuable resources is carried out in a manner that serves the best interests of the State and its people. The State ought to be able to derive optimal economic and fair and equitable monetary returns from its hydro-carbon resources. The State seeks to have a greater and more meaningful participation in both the upstream and downstream sectors of the oil and gas industry for Sarawakians and Sarawak Companies. For this reason, PETROS was formed to drive this agenda of the State.

PETRONAS, as a national oil company, when operating in Sarawak, must abide by our

State laws, particularly the OMO and the Land Code. The people of Sarawak wants PETRONAS to respect our State laws and their aspirations for better regulatory control over the exploitation of our oil and gas as well as for a more equitable and just share of the returns and benefits from the oil and gas obtained from Sarawak territory.

The Sarawak Government wants to ensure that the aspirations of the people are

realised and would continue to fight for the State‟s rights to the oil and gas obtained from our land both onshore and offshore. The amendments to OMO would create a more effective regulatory framework for the upstream sector and the downstream with the enforcement of the Distribution of Gas Ordinance, 2016. These are strong manifestations of the State

Government‟s commitments to safeguard the State‟s rights and interests over our oil and gas resources.

Tuan Speaker, the State Government is prepared to engage constructively with

PETRONAS to establish a regulatory framework for the exploration, prospecting and mining for oil and gas in Sarawak. The regulatory framework envisaged would not undermine PETRONAS‟s operations and investments in Sarawak. However, PETRONAS must demonstrate its willingness to respect and comply with our State laws. Also, PETRONAS should show its commitment to meet the aspirations of Sarawak for a more equitable and just returns from the exploitation of oil and gas and greater and more active participation by Sarawakians and Sarawak Companies in the upstream and downstream sectors of the Oil and Gas Industry in Sarawak.

For the information of this august House, Sarawak is the main producer of natural gas

and exporter of liquefied gas (LNG) in Malaysia. Based on the statistics made available by the Statistics Department of Malaysia (Monthly Statistical Bulletin, April 2018), the volume of LNG exported from Sarawak is 27 million metric tons with a total gross value of RM41.1 billion for the year 2017. The total crude petroleum exported from Sarawak for the year 2017 is 5,353,000 metric tons with the market value of RM9.4 billion.

According to the report published in June 2018 by Arthur D. Little, a well-established

international oil and gas consultant, oil and gas produced in the Sarawak accounted for about 30% of national oil production and between 60% - 65% of the total national natural gas production during the period of 2005 – 2015.

Currently, as per PETRONAS information dated December 2017, there are 41

Production Sharing Contracts‟ (PSC) 41 blocks of PSC, which are mainly located in the offshore Miri and Bintulu. The total gas productions are 4,123 million standard cubic feet or 680,000 barrels of oil equivalent per day for the year 2017. The total oil production is 173,000 barrels per day for the year 2017.

All these data confirmed that the major upstream activities in exploration and

production of oil and gas occurred in Sarawak. The oil and gas resources obtained from Sarawak contributed significantly to the national economy. Therefore, it is in both the State and national interest that the upstream activities should be properly regulated. In this respect, as constitutionally, the State has the legislative and executive authority over the exploration, exploitation and mining of petroleum, the regulatory regime for the upstream sector in Sarawak should be underpinned by our State laws.

The issue of ownership of Oil and Gas found on shore and offshore Sarawak will be

addressed in the context of the State‟s exercise of regulatory control over the Upstream Activities of exploring, prospecting and mining of oil and gas. The consequence of such regulatory control would be to have a much fairer and more equitable monetary returns from the exploitation of our hydro-carbon resources and much greater participation by Sarawakians and Sarawak companies in the Oil and Gas Industry in the State.

Tuan Speaker, the proposed amendments to be made to the Ordinance are designed

to attain the objectives outlined above. They include the following key provisions:-

(a) New definitions are added to section 2 of the Bill which includes: “Authority” means the State Minerals Management Authority established under the Mineral Ordinance, 2004 [Cap 56]. This amendment would enable the Authority to be the regulator for the upstream of oil and gas industry in Sarawak. “Minister” means, the Minister for the time being charged with the responsibility for natural resources. This amendment would make the Minister responsible for overseeing

the Authority in the discharged of its functions under the Ordinance and the enforcement of its provision.

Tuan Speaker, as indicated in my Notice to the Chairman under Standing Order 54(2),

I am proposing to make an amendment to this Clause on the definition of petroleum to ensure consistency in the terms used in that definition.

(b) A new Section 8 stipulates that a licence or lease shall not be assigned or transferred without the prior written approval of Majlis Mesyuarat Kerajaan Negeri.

(c) A new Section 8A on restriction on award of contract by a licensee or lessee. This

amendment is intended to regulate the award of contracts or entering into any agreement or arrangement with third parties, to undertake any activities permitted or authorised under the licence or lease because such contract or arrangement would have the effect of conferring rights, interests and benefits under the licence or lease to that third parties.

(d) A new Section 19 and Section 27 - which empower Majlis Mesyuarat Kerajaan

Negeri to grant oil prospecting licence and oil mining lease whether or not the applicant had previously been granted an oil exploration licence.

(e) A new Section 33, on “Overriding control by the Authority”. This amendment would

give the Authority the power to issue directions or guidelines to the lessee. (f) A new Section 33B, “Delegation by the Authority”. This amendment would allow

the Authority to delegate any of its powers, functions, duties or responsibilities conferred by this Ordinance to: (i) The Minister; (ii) A committee formed by the Authority comprising of its members or any other

persons named in the notification; (iii) Any public officer; or (iv) Any person.

(g) A new Section 33C is incorporated – to provide the State with the power to issue a single licence and lease comprising of oil exploration, oil prospecting and oil mining activities. Under the existing provision of the Oil Mining Ordinance 1958, the granting of rights and privileges are made through the granting of separate oil exploration licence, oil prospecting licence and oil mining lease. Based on feedback from the industry and other stakeholders, the investors would prefer having the option of investing in a mining activity whereby the rights to explore, prospect and mine oil can be granted in one single licence and lease. This would encourage greater investment in this industry.

(h) A new Part VI (6) provides for offences and penalties. (i) A new Part VII (7) provides for miscellaneous provisions. (j) It was also proposed that the date of coming into force of this Amendment Bill

would be on the 1st of January, 2018. However, pursuant to my Notice to the Chairman stated above, I am also proposing to make an amendment to this

Clause (Clause 1) so that the date of coming into force of the amendments will be the date on which the Oil Mining (Amendment) Ordinance 2018 is published in the Gazette.

Tuan Speaker, these amendments will enable the State to better regulate the upstream activities of oil and gas industry as well as for the State to have better control over the exploration, prospecting and mining of petroleum located inland both onshore and offshore of Sarawak. I would like to reassure investors that the State will continue to work with PETRONAS to ensure that their interests are protected. With these amendments and the ensuing regulatory framework, the occupation and use of land in Sarawak by PETRONAS and its contractors for the exploration, prospecting and mining of petroleum could be regularized to conform with the provisions of section 36(2) and 209(1) of the Land Code. Terima kasih Tuan Speaker kerana memberi peluang kepada saya untuk menyokong Rang Undang-Undang Oil Mining Ordinance (Amendment), 2018. Terlebih dahulu saya mengucapkan tahniah kepada Yang Amat Berhormat Ketua Menteri dan barisan peguam Negeri Sarawak yang telah menang dalam kes PETRONAS v Negeri Sarawak baru-baru ini. Kemenangan pertama ini adalah langkah yang diambil oleh Kerajaan Negeri yang menunjukkan solidariti dan semangat perpaduan yang tinggi dalam memperjuangkan hak-hak Sarawak. Usaha ini hendaklah diteruskan dan tidak terhenti dalam perkara minyak dan gas sahaja tetapi juga diperluaskan dalam Perkara–perkara 18 points dan MA 1963. Ini adalah selaras dengan kehendak Kerajaan Negeri untuk memberi hak-hak Sarawak yang telah terhakis.

Berikutan kejayaan tersebut, apakah pelan perancangan seterusnya daripada

Kerajaan Negeri. Ini penting kerana pemain industri minyak dan gas sedang menunggu-nunggu apakah perancangan dan pelan seterusnya daripada Kerajaan Negeri. Suka juga saya menegaskan bahawa keadaan yang tidak pasti (uncertainty) adalah tidak sihat kepada pemain industry dan juga kepada pelabur asing.

Tuan Speaker, dalam perkara 2(b) Rang Undang-Undang Oil Mining Pindaan 2018 ini telah mewujudkan State Minerals and Mining Authority dengan singkatan SMMA. Bagi saya ini secara langsung akan menguatkan lagi pihak berkuasa negeri untuk melaksanakan usaha sebagai regulator dalam industry minyak dan gas. Saya berharap agar mereka yang akan mengetuai SMA ini terdiri daripada mereka yang pakar dan berkebolehan untuk menyokong pertubuhan sektor huluan dan hiliran khususnya dalam bidang minyak dan gas dan dalam masa yang sama mereka ini wajib mempunyai jati diri yang tinggi kepada negeri Sarawak.

Suka saya memberitahu bahawa rakyat Sarawak yang berkebolehan ini ramai dan mereka ini berada di seluruh dunia. Kita boleh panggil mereka balik untuk berkhidmat

kepada SMMA ini. Untuk mengukuhkan SMMA ini, Tuan Speaker saya juga mencadangkan kepada Kerajaan Negeri agar mewujudkan Pelan Induk Bersepadu untuk industri minyak dan gas bagi negeri Sarawak untuk tempoh 20 tahun atau 30 tahun yang akan datang. Ini diikuti pula dengan pelan berkala lima (5) tahun. Pelan induk ini akan memberi halatuju strategik yang jelas tentang halatuju industri minyak dan gas di negeri kita ini. Pelan ini perlu mengambil input-input daripada pemain industri dan cerdik pandai anak negeri yang benar-benar faham akan industri minyak dan gas ini. Dalam masa yang sama pemain minyak dan gas tempatan perlu menjalin kerjasama strategik dengan industri lain dalam usaha membangunkan industri secara keseluruhan.

Maknanya Tuan Speaker, kita perlu ada Blue Print yang jelas tentang industri minyak dan gas di Sarawak dan ianya perlu dilaksanakan secepat mungkin. Saya yakin rakyat Sarawak sendiri mampu untuk merangka sendiri pelan ini kalau kita kembali kepada sejarah penerokaan terawal yang dibuat di Miri pada tahun 1910 dengan pusat pemprosesan petroleum pertama di Lutong. Saya juga ingin bertanya apakah usaha dan langkah Kerajaan Negeri iuntuk menyediakan usahawan tempatan untuk bergerak aktif dalam industri minyak dan gas? Kita tidak mahu lagi pemain-pemain industri minyak dan gas tempatan ini sebagai pemerhati. Industri ini hendaklah diperkembangkan dengan penglibatan rakyat tempatan dan contentnya adalah lebih kepada rakyat tempatan. Ini juga bakal memberi peluang pekerjaan kepada rakyat tempatan yang mempunyai minat dan kebolehan dalam industri ini.

Sebagai contoh, melahirkan model insan terlatih untuk menceburi industri minyak dan

gas seperti penerokaan, pengeluaran dan disediakan tempat untuk anak tempatan mendalami cabaran sebenar industri ini. Ini juga harus diberi perhatian sewajarnya daripada pihak Kerajaan Negeri supaya mereka mendapat tempat industri berkenaan. Sehubungan dengan itu, saya mengesyorkan agar institusi pengajian tinggi di Sarawak contohnya UNIMAS boleh menawarkan program Ijazah Sarjana Kejuruteraan Minyak dan Gas dengan bermatlamat untuk menyediakan kumpulan graduan yang berkualiti dan berkemahiran dalam bidang tersebut. Dengan erti kata lain, kita harus menyiapkan mereka dengan kepakaran yang sewajarnya dalam bidang ini.

Kesimpulannya Tuan Speaker, dengan wujudnya Oil Mining (Amendment) Bill, 2018 ini

akan memberi kuasa kepada Kerajaan Negeri untuk menjalankan kuasa-kuasa berkenaan dengan Oil Mining di Sarawak. Kita tidak mahu lagi berputih mata apabila ada pendapatan dan kutipan hasil negeri yang mantap dan berterusan sudah tentu kita dapat merangka lebih banyak pembangunan untuk rakyat dan negeri kita disamping meningkatkan pelaburan domestik dan luar negara.

Saya percaya Kerajaan Negeri Sarawak tidak akan berkompromi dan nekad

mempertahankan hak-hak yang terkandung dalam Perjanjian Malaysia 1963 (MA63) seperti mengurus minyak dan gas di negeri ini. Sudah tiba masanya Kerajaan Negeri Sarawak mengurus dan menjaga hak-hak Sarawak demi kepentingan rakyat Sarawak sendiri khususnya dalam menyalurkan lebih banyak pembangunan di luar bandar.

Saya juga menuntut supaya Kerajaan Pusat di bawah Pakatan Harapan untuk

melaksanakan janji manifesto pilihan raya mereka dalam mewalikan hak-hak Sarawak. Cukup sudah kita menjadi spectator kepada kejayaan negeri lain, kembalikanlah hak-hak Sarawak di negeri kita ini.

Justeru saya menyeru kepada Ahli Dewan yang mulia ini untuk terus memberi

sokongan yang tidak berbelah bagi kepada Yang Amat Berhormat Ketua Menteri untuk terus berjuang ke arah ini. Sekali lagi saya mengucapkan tahniah kepada Yang Amat Berhormat Ketua Menteri atas inisiatif beliau menubuhkan PETROS dimana diyakini mempunyai kepentingan strategik terhadap matlamat pembangunan sosio ekonomi Sarawak sepenuhnya.

Maka dengan adanya Rang Undang-Undang Oil Mining Pindaan 2018 ini akan

menyediakan peruntukan lebih baik dalam undang-undang berkaitan perlombongan minyak di Sarawak ini dan pelantar menuanya. Dengan ini Tuan Speaker saya menyokong Rang Undang-Undang Oil Mining Pindaan 2018. Sekian, terima kasih.

Tuan Speaker: Ahli Yang Berhormat Sadong Jaya. YB Ir Aidel bin Lariwoo: Terima kasih, Tuan Speaker kerana memberi saya peluang untuk membahas Rang Undang-Undang ataupun Ordinance to amend the Oil Mining Ordinance pada sidang kali ini. Tuan Speaker, in this OMO Amendment Bill, we can clearly see the effort by the State Government to further enhance, improve and advance of the ordinance to ensure smooth running of the administration and management of oil mining industries.

In the new Section 3A, Clause 4 is seeking to make provision on restriction against building, erecting, maintaining or decommissioning of any mining structures. In this regard Tuan Speaker, I would like to seek a clarification on the term „structures‟ in oil mining industries because „structures‟ in oil and gas should entail both „fixed‟ and „floating‟ structures as the nature of oil and gas exploration in example Floating LNG in Bintulu. And it is also good to add other mode of structures as the technology in oil and gas is fast developing.

Tuan Speaker, Section 28 in Clause 24 seeks to provide size of the mining area in oil

mining lease to be not more than two hundred and fifty square kilometre or less than ten square kilometres.

So, the extend or area affected under the jurisdiction of OMO or area under OMO and

the international water where the continental Shelf Act must be made clear and I think there must also be a provision in OMO relating to enforcement of any International Regulation affected by World‟s International Maritime Organisation or any United Nation Charter.

Tuan Speaker, Clause 28 provides for a new provision on overriding control by

authority, delegation of power and power to grant a single licence and lease for oil exploration, prospecting and mining. This is indeed a very good amendment to ensure a clear entity between the licensee and its contractors as the oil and gas involved many third party expertise.

In the Clause 34, it provides for MMKN or Majlis Mesyuarat Kerajaan Negeri to make

rules on the conduct of any environment impact assessment report relating to oil mining in the area to be issued with a mining lease, the construction etc of mining structures on land, onshore and in the continental shelf and keeping of a register of licences and leases by the authority.

Tuan Speaker, I believe this EIA reports should also be stressed on the aspect of

disaster, because if it happened – it must depict a clear line of responsibility and funding as we do not want an open ended responsibility as the one case of underwater pipelines burst n the Gulf of Mexico. And this must be covered clearly in this OMO.

Tuan Speaker, in view of the importance in this OMO amendment as an instrument to

regulate the oil and gas resources in Sarawak, and I strongly believe this OMO defined the ownership to the oil and gas in Sarawak that had been contested by PETRONAS under PDA1974. The standing of OMO is clearly spelt out in this amendment and we should honour it, as we inherited it since 1958.

Tuan Speaker, I should thank the State Government for an attempt to advance regulatory rights in the exploration, prospecting and mining activities in Sarawak through the oil mining ordinance, and with that Tuan Speaker, I beg to support the Bill. Thank you. Tuan Speaker: Ahli Yang Berhormat Jemoreng. YB Dato’ Murshid DiRaja Dr Juanda Bin Jaya: Assalamualaikum Warahmatullahi Wabarakatuh Tuan Speaker. Saya ingin menyatakan sokongan saya terhadap pindaan Rang Undang-Undang Oil Mining Amendment Bill 2018 dalam persidangan Dewan Undangan Negeri Sarawak yang bersejarah pada hari ini. Adalah menjadi tanggungjawab Dewan yang mulia ini menjadi penjaga dan pembela bagi hak-hak negeri Sarawak, demi masa depan rakyat Sarawak. Kita yang hadir dan berdebat hari ini akan dirakamkan di dalam sejarah sebagai orang–orang yang membela hak–hak Sarawak di peringkat Negeri dan Persekutuan. Oleh itu, langkah pindaan undang-undang pada hari ini adalah suatu langkah yang besar dan bersejarah. Ia bukanlah sesuatu yang terlewat kerana OMO telah wujud 60 tahun yang lalu iaitu pada tahun 1958 sebelum wujudnya Malaysia.

Hari ini, kita sepakat agar hak-hak Sarawak ditegakkan. Memang pasti ada pihak yang akan salah sangka terhadap tindakan negeri Sarawak. Bukan hanya di peringkat Persekutuan, bahkan pemain-pemain industri minyak dan gas seluruh dunia pasti melihat perkembangan ini sebagai sesuatu yang besar dalam sejarah petroleum di Malaysia.

Oleh itu, dengan berlalunya PRU ke-14 dan bermula sesuatu yang dipanggil sebagai

Malaysia yang baru, yang dikatakan akan memberi ruang kebebasan bersuara yang lebih luas, juga ruang menuntut hak yang lebih baik, maka sewajarnya, apa saja yang berkaitan dengan hak Sarawak yang telah terhakis mesti dibincang, didebat dan diusahakan untuk diambil kembali oleh Sarawak melalui kuasa-kuasa yang telah diberikan oleh undang-undang dan Perjanjian Malaysia 1963 (MA63) kepada Dewan yang mulia ini.

Maka saya pada hari ini mengesyorkan agar Dewan yang mulia ini, perlu memikirkan

ruang perdebatan berkaitan dengan kuasa–kuasa yang telah diberikan oleh Parlimen kepada pihak Persekutuan mengenai Petroleum Development Acts, 1974 dan Territorial Sea Act, 2012, memandangkan sebahagian hak-hak Sarawak telah terhakis akibat dua (2) undang-undang yang diluluskan tanpa mengambil pandangan Dewan yang mulia ini. Suatu komiti di bawah Dewan yang mulia ini dicadangkan untuk ditubuhkan agar tindakan lanjut setelah pindaan OMO ini dapat dilakukan, bak kata pepatah, sediakan payung sebelum hujan, kerana pindaan OMO pada hari ini pasti akan ada pihak yang tidak akan senang hati.

Tuan Speaker, melalui PDA 1974, Sarawak hanya menerima royalti melalui TSA 2012,

laut milik kita hanya sehingga 3 batu nautika sebagaimana yang disebut dalam Sekyen 3 (3) Akta TSA berkenaan.

Maka Malaysia baru yang wujud sejak 9 Mei 2018 dan proklamasi darurat yang

disytiharkan oleh Yang di-Pertuan Agong pada 15 Mei 1969 yang telah tidak wujud sejak 24 November 2011, maka kita rakyat Sarawak kini wajar mengambil kesempatan keemasan ini untuk ambil kembali hak-hak yang telah sekian lama terhakis agar negeri ini lebih berdaulat, bebas dan utuh.

Tuan Speaker, minyak dan gas adalah antara hak-hak kita daripada hasil negeri bumi

kenyalang yang kita cintai. Ini hak kita, negeri ini maruah kita, hasil bumi negeri ini adalah hak anak cucu kita. Maka kita semua Ahli-ahli Dewan yang mulia ini adalah anak-anak Sarawak yang pasti cintakan Sarawak, Ibu Pertiwi kita semua. Oleh itu, kita semua mesti

menyokong apa sahaja usaha untuk menjaga masa depan negeri ini. Kita tidak pernah berhasrat mengambil hak orang lain. Kita juga tidak akan bergaduh dan tidak mahu bergaduh dengan sesiapa pun dan Sarawak adalah negeri yang paling harmoni di dalam Negara ini. Bahkan sewaktu darurat 1969, diisytiharkan, Sarawak tidak ada pergolakkan. Oleh itu, tidak ada sesiapa pun punya hak untuk tidak puas hati terhadap langkah-langkah yang kita ambil pada hari ini untuk mengembalikan hak-hak kita.

Tuan Speaker, Sarawak menjadi ahli utama membentuk Malaysia pada tahun 1963,

iaitu 58 tahun yang lalu tetapi malangnya pembangunan luar Bandar masih di takuk lama. Jalan raya, sekolah, klinik, jambatan dan sebagainya masih banyak yang perlu dibina. Duit tambahan amat diperlukan. Sudah terlalu lama Sarawak mendengar banyak janji-janji manis dari seberang Laut China Selatan tentang royalti minyak dan gas, tentang peruntukan luar Bandar dan sebagainya. Namun luar bandar Sarawak masih tidak dibangunkan. Maka dengan pindaan OMO ini, diharapkan penambahan pendapatan negeri dapat diperolehi dan dicadangkan ia diletakkan secara khusus sebagai tabung untuk pembangunan luar bandar Sarawak. Hal ini jika berlaku, pasti akan menggembirakan seluruh rakyat Sarawak, sama ada rakyat yang menyokong GPS, PH atau mana-mana aliran politik. Biarlah orang Sarawak sendiri menguruskan sendiri negeri ini tanpa menunggu persetujuan pihak-pihak dari luar negeri Sarawak.

Akhir sekali Tuan Speaker, suka saya cadangkan, baru masuk dalam pindaan, agar

penguatkuasa khusus bagi OMO ini diwujudkan kerana tanpa penguatkuasaan, apalah gunanya undang-undang dan seterusnya denda RM200,000 yang dinyatakan dalam Seksyen 3, 4 dan 34a dicadang untuk dinaikan kepada RM2 juta.

Dengan itu Tuan Speaker, saya dengan rendah hati menyokong pindaan rang

undang-undang ini. Terima kasih. Tuan Speaker: Ahli Yang Berhormat for Repok. Saya berpendapat bahawa masanya telah tiba dan amat bertepatan sekali untuk Kerajaan negeri Sarawak mengambil langkah dan tindakan yang konkrit dalam menjaga dan memelihara hak kita yang termaktub dalam Perjanjian MA63 dan Perlembagaan Negeri Sarawak demi menjamin hasil mahsul Negeri kita dikawal selia kita sendiri demi menjamin kemakmuran Negeri kita. Saya ingin menyatakan di sini bahawa saya amat menyokong agar rang undang-undang ini diluluskan.

Seperti yang kita sedia maklum, mulai 1 Julai 2018, Kerajaan Negeri telah menguatkuasakan Oil Mining Ordinance 1958, di mana ianya memberi kuasa secara eksklusif kepada negeri Sarawak untuk mengurus dan menyelia operasi minyak di negeri Sarawak. Semua syarikat minyak yang beroperasi di Sarawak mesti mematuhi Ordinan tersebut.

Pada saya, ini bertepatan sekali bagi memastikan Sarawak dapat menguruskan

sumber minyak dengan mengawal selia semua syarikat minyak yang beroperasi di Sarawak. Pada masa yang sama, kita bekerjasama dengan Petronas di dalam rangka Ordinan ini supaya membawa manfaat kepada Malaysia amnya dan negeri Sarawak khasnya.

Tuan Speaker, kita tidak boleh lagi leka dan bertangguh lagi dalam menguatkuasakan

Ordinan ini. Dalam pada itu, di sini saya juga ingin mengucapkan syabas dan tahniah

kepada pasukan perundangan kita atas kejayaan mereka dalam mempertahankan hak-hak kita di Mahkamah Persekutuan baru-baru ini.

Saya yakin bahawa penguatkuasaan Ordinan ini akan menjadi salah satu sumber

pendapatan utama bagi negeri Sarawak, yang bakal membolehkan Sarawak melaksanakan dan melancarkan lagi projek-projek pembangunan demi kebaikan rakyat dan kemakmuran negeri Sarawak Bumi Kenyalang yang kita cintai. Saya berharap lebih banyak syarikat-syarikat Sarawak dapat diberi peluang kontrak dan perniagaan dan lebih ramai anak-anak Sarawak dapat diberi pekerjaan dalam bidang minyak dan gas.

Untuk itu Tuan Speaker, sekali lagi saya ingin menyatakan sokongan yang tidak

berbelah bagi agar Oil Mining (Amendment) Bill, 2018 yang dibentangkan pada hari ini diluluskan. Sekian, terima kasih. Tuan Speaker: Ahli Yang Berhormat for Piasau. YB Datuk Sebastian Ting Chiew Yew: Tuan Speaker, thank you very much for giving me the opportunity to join the other Honourable Members of this august House in debating the Oil Mining (Amendment) Ordinance 2018. I would like to congratulate our Government, in particular also, our Deputy Chief Minister Yang Berhormat Datuk Amar Haji Awang Tengah for tabling a very comprehensive Bill.

Tuan Speaker, the original Oil Mining Ordinance was passed in 1958, 50 years ago, and it is timely for this Bill to update the Oil Mining Ordinance to have a better provisions in the law to give the power to the State the regulatory rights over its oil and gas activities in both onshore and offshore of Sarawak. The Oil Mining Ordinance will require the oil and gas contactors, subcontractors and vendors operating in Sarawak territorial waters to obtain a necessary licences and approvals from the Sarawak Government or risk being deemed as illegal under our State Law.

Tuan Speaker, only yesterday our Yang di-Pertua Negeri Sarawak Tun Pehin Sri Abdul

Taib Mahmud, had reiterated that Sarawak Government would be able to manage its natural resources well, particularly oil and gas, to ensure that Sarawakians could benefit from them. The establishment of PETROS is in line with the government‟s efforts to manage the development of oil and gas industry in Sarawak.

I would like to refer to the amendment of Section 3 of the Principal Ordinance where

the words “ten thousand dollars” assessed way back in fifty years ago are now substituted with the words “two hundred thousand ringgit.” This Section refers to penalty for exploration, prospecting or mining for oil and gas without receiving lawful authority, i.e licence, to do under the principal Ordinance.

However, the New Section 3 A, I would like to say that it is different. The New Section

3A says “Restriction Against Building, erecting etc. of mining structures”. Section 3A (1) says;

“No person shall build, erect, maintain or decommission any mining structure on any land onshore or in the continental shelf unless authorized by the terms in any license or mining lease issued under this Ordinance or with the approval in writing of the Authority and subject to any condition or restriction imposed in that license, mining lease or approval granted by the Authority”

3A(2) says;

“Any person who fails to comply with subsection (1) shall be guilty of any offense and shall upon conviction, be punished with a fine or not exceeding two hundred thousand ringgit or imprisonment for a term not exceeding three years or to both”

Tuan Speaker, I like to look at the quantum of the fine of RM200,000.00 only upon

conviction. I am sure that all of us know that in the oil and gas industry RM200,000.00 is nothing compared to millions of ringgit that a person can pump per day. Indeed in criminal matters it takes a long time, a year, two or more, for a court to convict a person for such wrong doing. While the case is on going the person continues to pump the oil and gas, making millions of ringgit.

Therefore, I would like to propose an amendment to Section 3A(2) to:

“A fine of two hundred thousand ringgit for every day that the offence is continued after the serving of notice to the person”.

Oil and Gas Revenues

Tuan Speaker, I would like to touch on the oil and gas revenues. The oil and gas

revenues found within Sarawak‟s territorial waters belong to Sarawak and all Sarawakians as a whole. It is our inalienable rights over our natural resources and therefore we must safeguard our own resources. Since the discovery of oil in Miri in 1910, we have been receiving oil royalty from SHELL annually then and this continues on even after the Malaysia Day. Though the Oil Mining Ordinance, 1958 was passed before the Malaysia Day, it is still a good law and only applicable in Sarawak. Thanks to the protection given in Section 73 of the Malaysia Agreement.

On the 4th June 2018, (just 26 days after PRU14) Sarawakians woke up to find out that

PETRONAS had filed an application in Federal Court for leave to commence proceeding over ownership right to Sarawak‟s oil and gas resources. It was originally scheduled to be heard by the Federal Court on the 12th June 2018 but subsequently postponed to 21st June 2018. On 22nd June 2018, the Federal Court delivered its judgment and dismissed the PETRONAS application for leave.

Tuan Speaker, the people of Sarawak were very concerned with this PETRONAS suit

against the Sarawak Government and were fully behind our government. Indeed, they were very happy when the Federal Court refused to grant leave to PETRONAS.

Here, I would like to take this opportunity to congratulate the Sarawak Government.

Congratulations also to Assistant Minister for Law, State and Federal Relations and Project Monitoring, YB Sharifah Hasidah for handling this matter since day 1 and the Sarawak legal team comprising State Attorney General; Datuk Talat Mahmud Abdul Rashid, State Legal Counsel; Dato Sri J.C Fong and the Sarawak State Attorney – General‟s Chamber for the wonderful job well done. I would like to mention here and appreciate the full support from the Advocate Association Sarawak led by their President Mr Ranbir Singh.

Tuan Speaker, we need to remind ourselves constantly that, we did not join Malaysia,

we formed Malaysia and we did not formed at the expense of our resources being taken away from us. We formed Malaysia based on the understanding that we would have political and economic cooperation to share the wealth together but the ownership of oil and gas resources must belong to the people of Sarawak. Therefore, as owners of these resources, it is our Right to regulate the exploration, prospecting and mining of our resources. It would be fair statement that if our founding fathers in 1963 knew that forming Malaysia would result

Sarawak losing its oil and gas ownership, they would never have agreed to sign the Malaysia Agreement.

Tuan Speaker, I refer to the State Constitution Article 47(2), it‟s says that

“Any land in the State which immediately before the commencement of this Constitution was vested in Her Majesty shall on commencement of this Constitution vest in the State”.

The commencement date of the State Constitution was when we formed Malaysia on 16th September 1963.

Therefore immediately on 16th September 1963, all land including natural resources (oil and gas) in the seabed and subsoil in Sarawak Continental Shelf as defined in the Sarawak (Alteration of Boundaries) Order in Council 1954 made on 24 June 1954 belong to Sarawak.

Tuan Speaker, the ownership of oil and gas belongs to the Sarawak people and only

through the passing of laws in the State Legislative Assembly can our State boundaries such as the Territorial Waters can be changed. It is important to note that our State Legislative Assembly has never passed any law that alter our boundaries.

Therefore legally our State has full control over our land unchanged since 16

September 1963. Tuan Speaker, our people will certainly be happily to know that we will have more oil

and gas revenues and are likely to ask, what we do with the additional revenue from oil and gas. How can they benefit? Apart from the usual improvement on public infrastructures for the rural and semi-rural community, we should consider to improve on the public transportation, clean water distribution, power distribution and health care. I would like to suggest something different like issuing a share in PETROS to each and every Sarawakian including the new born in the future. As part of transparency and accountability, every year, PETROS will report their revenues of the year to the legislative assembly and with the approval of the legislative assembly; the dividend will be paid out to all Sarawakians. Of course, the Government has to come out with a formula to determine the appropriate dividend to be given each year. Sarawakians as a whole, will surely be happy and look forward to receiving this yearly dividend.

We should also consider setting up a Sarawak sovereign fund or Oil Fund. We need to plan for the future that one day the oil and gas resources will come to an end. Such fund is to ensure that the future generations continue to benefit from the oil and gas revenues and at the same time, providing financial security for Sarawak in case there is an unforeseen economic challenge. The Oil Fund will also invest in stocks, bonds and real estate abroad and locally for higher return of investment and I believe that our Development Bank of Sarawak (DBOS) should be the right government arm to handle such investment.

Tuan Speaker, with the above observations I fully support the Oil Mining (Amendment) Bill, 2018. Thank you. Tuan Speaker: Ahli bagi Demak Laut. kita ucapkan kepada Yang Amat Berhormat Ketua Menteri dan Kabinet Negeri yang telah meluluskan untuk meminda Oil Mining Ordinance 1958 supaya lebih kemas kini untuk tujuan penguatkuasaan yang lebih berkesan.

Tuan Speaker, di atas niat dan tujuan perjuangan yang baik, suci dan murni ini kita telahpun mempunyai kuasa penuh untuk mengawal selia industri minyak dan gas di Sarawak melalui Oil Mining Ordinance 1958 yang telahpun diluluskan di Dewan Undangan Negeri Sarawak (Sarawak Council) pada 1958 berkuatkuasa pada 9 Jun 1958. Oil Mining Ordinance 1958 masih lagi berkuatkuasa hingga ke hari ini.

Tuan Speaker, dengan adanya pemindaan akta Oil Mining Ordinance 1958 ini, maka

Kerajaan Negeri Sarawak akan dapat menguatkuasakan Oil Mining Ordinance dengan lebih berkesan dan efektif demi untuk menjana pendapatan yang lebih baik untuk membantu golongan yang memerlukan dan juga untuk melaksanakan projek-projek pembangunan asas tanpa perlu terlalu bergantung pada peruntukan oleh Kerajaan Persekutuan. Dalam masa setahun lagi, Insya-Allah kita akan dapat meningkatkan pendapatan negeri Sarawak.

Tuan Speaker, before Malaysia Day on September 16, 1963, Sarawak had already

owned all the petroleum resources both onshore and offshore in the Continental Shelf. The State has complete control over the grant of prospecting, exploration and mining rights within the boundaries of Sarawak which by virtue of Article 2 of Federal Constitution cannot be altered without the approval of the State by a law passed by the State Legislature.

Tuan Speaker, on Malaysia Day, the State has the constitutional rights to issue

prospecting licenses and mining leases under Item 2(c) of the State List in the Ninth Schedule of the Federal Constitution which provides that land including permits and licences for prospecting for mines, mining leases and certificates are under the legislative authority of the State and therefore, by virtue of Article 80 is within the executive authority of the State Government of Sarawak. The Federal Government‟s right under Item 8(j) of Federal List in the Ninth Schedule is subject to item 2(c) of the State List. This means the Federal Government‟s authority on oil and oilfields and the development of mineral resources is subject to the State‟s rights to grant mining right for oil and natural gas within Sarawak.

Tuan Speaker, the Sarawak Oil Mining Ordinance was never repealed by any

emergency laws promulgated when the 1969 Proclamation of Emergency was in force. The 1969 Proclamation of Emergency was annulled in 2011. Thus, Sarawak is constitutionally entitled to enforce the Oil Mining Ordinance and assert a Constitutional authority under the rights to mine oil and gas in Sarawak.

Tuan Speaker, therefore, all mining players operating in Sarawak must comply with the said Ordinance and other State Laws such as the Gas Distribution Ordinance and the Land Code.

Tuan Speaker, the State would gain financially through premium, rent or licence fees,

which may be levy under the Land Code on its contractors, for the use or occupation of land in Sarawak including the State Land in the Continental Shelf which will yield added revenues to the State Treasury. The State Government would be able to ensure greater and more participation by Sarawak companies and Sarawakians in this industry. The Spin-Off effects will definitely benefit Sarawakians directly and boost the GDP of the State.

Tuan Speaker, with this, I strongly hereby support the Oil Mining (Amendment) Bill,

YB Datuk Ding Kuong Hiing: Thank you Tuan Speaker, for allowing me to take part in the debate for Oil Mining (Amendment) Bill, 2018.

It is very timely and appropriate that the Oil Mining Ordinance, 1958 is put up for amendment in this august House after 60 years. Not only many definitions are outdated and some provisions are no longer suffice to cover various activities in the petroleum industry. For example, definitions like “British subjects”, “Crown land” as in sections 2(c) and 2(d) are definitely inappropriate and need to be deleted. Whereas section 2(i) gives a new definition to petroleum which means, “any mineral, oil or relative hydrocarbon and natural gas existing in its natural condition and casing head petroleum spirit including bituminous shales and other stratified deposits from which any mineral, oil or relative hydrocarbon and natural gas can be extracted”.

I would like to join my other Honourable members in giving my thoughts on Clause

34(a) general penalty for contravening any provision should be increased from the two hundred thousand ringgit as specified in the amendment bill.

Tuan Speaker, the importance of the amendment of this Bill is made even more

significant after the recent application by Petronas to appear in the Federal Court for a declaration that Petronas is the absolute owner and regulator of petroleum in our State. The passing of the Oil Mining (Amendment) Bill, 2018 will further strengthen our position to exercise our power to regulate the petroleum industry in Sarawak.

Tuan Speaker, Sarawakians are anxiously waiting for the new Federal Government to fulfil their pledge of giving 20% oil royalty to Sarawak amongst others. This uncertainty certainly makes us all the more determined to be ready and prepared to go all the way to protect the rights and privileges of all Sarawakians. Let us rally behind Yang Amat Berhormat Chief Minister and his Government and give our strongest support for our common cause. With this, I beg to support the Oil Mining (Amendment) Bill, 2018 tabled by Honourable Member for Bukit Sari. Tuan Speaker: Member for Padungan. YB Encik Wong King Wei: Thank you, Tuan Speaker, for allowing me this opportunity to participate in the debate of the OMO (Amendment) Bill. I stand to support this amendment with some reservations and also my observations on the amendment bill.

On Section 3 of the Principal Ordinance, it creates the criminal offence for those operator or explorer who is exploring, prospecting or mining on any crude oil, petroleum or natural gas with the increment of the penalty or fine from RM10,000 to RM200,000 and also including a possibility of imprisonment. Oh no, that is only fine, it is a fine section. And there is another additional new Section 3A.

New Section 3A also provided that no person shall build, erect, maintain or

decommission any mining structure on any land, onshore or in the continental shelf unless it is authorised by this Ordinance which is coming into force after the amendment. So, subject to any conditions or restrictions imposed in that licence. It means that now all the operators or explorers, you need licence. For now, there are a lot of these existing operators. How the Minister is going to tackle the problems after the amendment. I believe there will be enforcement according to the clauses of this Ordinance. How are the existing operators or explorers going to operate or going to explore the existing structure or oil mining activities?

I believe with the tabling of the amendments, yes we highlighted in public that the Government is going very hard against all these operators after the amendments has been done. Enforcement will come into place and this create anxiety in the industry.

I believe that this will jeopardize the investors and also jeopardize the industry. So we

do not want the economy of oil industry and gas industry in this State in Sarawak will be jeopardized. Deal through the amendments or deal through the enforcement of the clauses or of the Section under these ordinance. That is number one.

Number 2, by highlighting this issues of OMO which has never been highlighted during

the ruling of the Barisan Nasional Government in Federal level. Now, on the highlighting this issue, now to me this is a playing of wayang kulit too. Don‟t worry, I haven‟t finish, you agree with me, you agree with me. A play of wayang kulit just to cover your failure, your failure to get 20% oil royalty.

So you say now, the highlight now, the attention should be the ownership, attention is

to be the mining rights. But how about 20% oil royalty, which we all have to prove here, passed in this house, this honorable August House a resolution has been passed and GPS Government has fail to execute the resolution, so I would say that this GPS is not giving the correct direction. For what, this is a malfunctioning GPS which cannot provide any direction for the people. Tuan Speaker: Order. Order. Order. Order. Order. YB Encik Wong King Wei: You will have your time. Tuan Speaker: Order. Order. YB Encik Wong King Wei: This is not only our agenda, this was the agenda of the late Tok Nan, a former Chief Minister of Sarawak who has fought so hard for the 20% oil royalty but until the hands of the new administration, you have failed us and Pakatan whatever it is be that it may, Pakatan Harapan Federal Government is determine to give a further of 15% oil royalty or of equivalent value to oil producing State including Sarawak. We are making the industry more prosperous. You are creating the confusion in the industry but we are making the industry more prosperous so that we can make Sarawakians richer because of the resources that have been gifted by our Almighty God.

The application filed by Petronas in Federal Court indeed was through clear the confusion that has been created by GPS Government of Sarawak. The confusion that you have created. You have created the confusion in the sense that, who is having the ownership rights as who is having the mining rights what so ever, but you tried to divert the attention from the failure that you have committed by getting 20% of the oil royalty from the Federal Government. It is shameful, it is shameful for GPS Government to mislead the people of Sarawak that you have won the battle in Federal Court level.

It is not the winning of battle, if any legal profession will know that by successfully resisting the leave of the Federal Court, which the application was made by the Petronas. It is not the winning of the battle. The confusion remained. You have misled the people of Sarawak that you have won the battle, but in fact you have not. The fact that the question of law as to whether OMO prevails over PDA 1974, whether OMO still has any legal effects after the codification of PDA 1974. This issue, this legal issue remains unanswered. Therefore, I say that it is not a winning battle but it is a lost to all Sarawakians.

Particularly, that the oil and gas industry in Sarawak has been seriously jeopardized. 20% oil royalty was the fight of the late former Chief Minister of Sarawak as well, and endorsed by Pakatan Harapan Sarawak and also in the Federal Level.

This amendment is creating more confusion and also more confrontation to the

So the Government had to take initiative to answer and to clear the confusion that has been created by your own for just the purpose of playing wayang kulit to the public. Ok, I take the question from Maradong. YB Datuk Ding Kuong Hiing: Thank you, Honorable Member for Padungan. Just one question, do you agree that the oil and gas in Sarawak belongs to the Sarawak people or to Petronas? YB Encik Wong King Wei: I believe that YB Meradong needs tuition. It used to belong to all Sarawakians but given by Barisan Nasional Government in 1974 to PDA through the Federal, to Petronas. And now, it is not the question whether I agree that we owns it. It is about the legal issue whether this needs the determination in the Federal Court. The question asking me that whether I am agreeing to that it won‟t affects the legal effect of PDA 1974. You have to ask yourself why you want to give the rights away, the ownership rights away to PETRONAS, to Malaya? You have to ask yourself, blame yourself for that. Tuan Speaker: Order. Order. YB Encik Wong King Wei: You think OMO can clean your history? No, there is no way OMO can clean your history. The dirt is still there, the dirt is in your hands and you have to answer, you all Sarawakians and answer as why you gave that away. Sold our rights to Malaya. Therefore, these are the two issues that I have raised, I hope the Minister can answer how you are going to clear the confusion and also as to the existing operators. How will you solve the issue as the existing operators? Because, they are there now. The issue will remain unsolved with the passing of this amendment bills. With that I conclude. bahawa ianya masih tidak mencukupi dan saya berpendapat bahawa Kerajaan harus menguatkan lagi usaha untuk menambahkan lagi program-program ini.

Jadi, saya ingin menuntut dan saya juga pernah memaklumkan dalam Dewan yang mulia ini bahawa perjuangan kita ya, untuk menaikkan royalti ke 20% itu penting. Tetapi tidak semestinya ianya berhenti di situ dan ianya tidak mencukupi. Jadi, saya ingat perjuangan untuk 20% ini, the war cry to get the 20% royalty dan penggunaan 20% royalti oleh pihak Pembangkang untuk menghentam pihak Kerajaan saya rasa tidak relevan lagi kerana saya selaku orang muda ataupun belia di negeri Sarawak, kita mahu Kerajaan mengikhtiarkan untuk mendapatkan income yang lebih untuk negeri Sarawak. Kenapa? Kerana kita hendak mempergiatkan program-program yang telah saya sebutkan awal tadi dan mungkin Kerajaan boleh memperkenalkan lagi program-program kebajikan yang baru untuk manfaat rakyat Sarawak.

So, we should be aiming more and work towards achieving it, not only for the sake of

fulfilling our political war cry but for the people. Jadi oleh itu, saya mulanya tadi hendak memohon bantuan daripada rakan PH kita untuk since they are the Government of the day, di Federal Government, so since mereka telah mengatakan bahawa Kerajaan kita telah memberi hak minyak kepada Kerajaan Persekutuan, pada mulanya, saya ingin mohon pihak Pembangkang untuk memaklumkan kepada Kerajaan Pakatan Harapan kembalikanlah hak tersebut kepada kami.

Pada mulanya, tetapi kita telah pun melihat bahawa Pakatan Harapan di Sarawak ini

tidak diperendahkan oleh Pakatan Harapan di Semenanjung jadi saya rasa tak perlulah saya memohon pertolongan rakan kita. Let us do it ourself. Itu yang pertamanya, kerana saya pasti GPS mempunyai a very firm destination that where we are going so we are heading towards that.

So it is okay YB, and the other thing was the confusion, the confusion yang masih lagi

tertanam dalam hati dan minda saya berkenaan dengan manifesto Pakatan Harapan maknanya Pakatan Harapan di Sarawak saya pernah melihat manifestonya mengatakan bahawa mereka akan lupuskan hutang PTPTN bila mereka menang dalam pilihanraya ini. Itu saya pernah tengok. Saya, I am just confuse, I am getting to that, it is okay. The confusion, I am talking about, the confusion of what you said about OMO and this one I am just citing an example, citing an example. Thank you YB. Jadi, jadi bila saya lihat di semenanjung dia kata bila menang mereka akan, tak payah bayar PTPTN sampai dapat gaji RM4000.00.

Jadi this confusion menyebabkan saya rasakan bahawa, yes I think I should not be

asking them for help to get our hak kembali ke negeri Sarawak. I am just citing an example, so that‟s why we are working towards this.

Dan saya juga melihat pemantapan OMO ini amat adil sekali and timely dan

pelaksanaannya juga berdasarkan semangat asal penubuhan Malaysia dan berlandaskan Perlembagaan Malaysia. Kita bukannya menguatkuasakan perkara yang kita reka baru-baru ini berdasarkan keperluan semasa yang kita rasakan kita perlu tetapi ianya berdasarkan hak yang telah dipersetujui bersama dalam kita membentuk Malaysia. Jadi hasrat utama Kerajaan Persekutuan atau pun Kerajaan Negeri adalah untuk melihat rakyatnya sejahtera dan tidak menganiayai mana-mana pihak dan saya yakin dengan penguatkuasaan Ordinan ini ataupun Undang-undang ini saya yakin kita mampu bekerjasama dengan bukan sahaja Petronas tetapi mana juga syarikat-syarikat ataupun Stakeholders yang mempunyai minat untuk bekerjasama dengan Kerajaan Negeri Sarawak untuk mengeksploitkan oil and gas di Negeri kita untuk the benefit of the people of Sarawak. Saya yakin Kerajaan mempunyai semangat ini dalam membentuk ataupun menggubal undang-undang ini.

Jadi kita juga sering mendengar isu bahawa kekurangan penglibatan syarikat-syarikat ataupun anak-anak tempatan dalam aktiviti-aktiviti downstream. Jadi dengan penubuhan PETROS dan SMMA ini maka kita yakin bahawa kita dapat mengawal selia dan memastikan penglibatan yang lebih tinggi oleh anak-anak tempatan dan syarikat-syarikat tempatan. Flexing The Muscle Approach by PETRONAS, saya rasa tidak akan membawa kita ke mana-mana. Apa yang penting adalah kita hendak memberi yang terbaik kepada rakyat, kita mahu rakyat merasakan nikmat hasil bumi negeri kita dan saya amat bersetuju tadi dengan ahli daripada Piasau di mana mencadangkan bahawa perolehan daripada oil and gas ini haruslah dikongsikan bersama dengan rakyat-rakyat. Apa cara sekalipun saya yakin Kerajaan mempunyai program ataupun cara-cara yang terbaik untuk memastikan rakyat dapat merasakan hasil nikmat ini dalam program kebajikan ataupun dalam program bantuan bulanan ataupun dalam program bantuan pendidikan. Tapi ianya mesti dirasakan oleh seluruh Rakyat Sarawak. Jadi itu sahaja pernyataan daripada saya untuk menyokong Rang Undang-Undang ini.

Tuan Speaker: Honourable Member for Batu Kitang

YB Ir Lo Khere Chiang: Thank you, Honourable Tuan Speaker. Thank you for the opportunity to debate on this Oil Mining Amendment Ordinance OMO, 2018. I wish to congratulate the Minister for Urban Development and Natural Resources for tabling this Oil Mining Ordinance.

The proposed amendment of this Bill reinforces the privilage of Sarawak position on the exploitation of our own oil resources. All along, Sarawak‟s position on OMO 1958 is known to everyone in and outside Sarawak. With the proposed amendment today we are now a step nearer to gaining financial independence for Sarawak as oil is a major source of income and energy source for Sarawak. This rights have been mooted by our late Tok Nan and persued vigilantly by our Honourable Chief Minister.

I am sad to hear that our Honourable Member for Padungan this morning is not in

tandem with the State in pursuing this right. Let me remind our Pakatan Harapan friends in Sarawak that today Pakatan Harapan has 113 seats plus 56 seats in Sarawak and Sabah. We can amend any bill in Parliament. And so I would encourage all of us to work together, Pakatan Harapan Sarawak and GPS for the benefit of our people in Sarawak and the future of our people. I support this Oil and Mining Amendment Ordinance by the Minister for Urban Development and Natural Resources. Thank you, Tuan Speaker. Tuan Speaker: Any Honourable Member wishes to speak? Honourable Member for Bukit Assek. YB Puan Irene Mary Chang Oi Ling: Tuan Speaker, our country‟s political landscape has changed. It is no longer a comfort zone for the BN or even GPS government when the rakyat could be so easily appeased. The people are crying out for accountability, for justifications and for solutions. It is therefore wise for the State Government to heed these cries and to distant itself from the previous BN coalition in their administration of our state and country. This would mean a complete divorce from the previous administration and whether this can be achieved, only time can tell.

The PH coalition, Tuan Speaker, is mindful always that we are not the masters of the people but instead are here to serve the people. We have a very big task in our hands, given

the legacy of a broken administration left behind by the previous BN Federal Government. As for the PH Sarawak, Tuan Speaker, we are always on the side of the people of Sarawak, no matter what allegations and accusations that may be hurled against us about being a Malayan party. For even in law, it is recognised that it is not the name of a legal instrument which determines its identity but the substance of it. And the substance of this, is that those of us sitting in PH Sarawak, recognise and acknowledge, along with our people that Sarawak has been short changed by the BN Federal Government for the past 55 years. The people knows that Malaya, Putrajaya township, Petronas and the Petronas Twin Towers would not be what they are today if not for Sabah and Sarawak‟s oil and gas revenues.

Therefore, Tuan Speaker, the State Government of Sarawak should not be faulted in

the introduction of this Bill which seeks to amend the OMO 1958. Indeed, it is an attempt to rectify the wrongs committed on the people of Sarawak and as the ruling Government in charge since the formation of Malaysia, the State Government has a lot of rectification to do. However, I, like the Honourable Member from Pandungan, have plenty of reservations of whether this is the right way to go, given that the main focus should not be in respect of regulatory control of the licenses issued but should be on the ownership of the petroleum exploited in our territorial waters.

In gist, if we look at the intention of the amendments proposed, the State wants to

strengthen our claim to regulatory control over the resources found in the territorial waters in our land. But the question is, what territorial waters are we talking about, Tuan Speaker, when our rights over these waters have been limited to 3 nautical miles by the Territorial Sea Act 2014? If we look at the Bill, Clause 30(c) proposes amendments to Section 34 of the Principal Act 1958 that the Authority shall have power to grant an oil mining lease for an area not more than the area stipulated in the precedent prospecting license or where there is no prospecting license, of an area not exceeding one hundred square kilometres or such other limitations in size as may be determined by the Majlis Mesyuarat Kerajaan Negeri by a direction published in the Gazette. Tuan Speaker, one hundred square kilometers is 29.15 nautical miles. It far exceeds the 3 nautical miles provided in the Territorial Sea Act. Do we draft our legislation which is inconsistent with a Federal legislation?

Tuan Speaker, as we should all know, where Federal legislation and State legislation

are at odds, the State legislation is void as far as where the inconsistency is concerned. Likewise, Tuan Speaker, while we insist on regulatory control of the resources,

including petroleum found on our shores, the PDA 1974 provides that Petronas has the exclusive rights, powers, liberties and privileges of exploring, exploiting, winning and obtaining petroleum whether onshore or offshore in Malaysia, and that should include Sarawak. That is found in Section 2 of the PDA. Giving Petronas such exclusive rights through an Act of Parliament, it connotes that no license or lease should be required for such activities over our land. This is inconsistent with the intention of the Ordinance which we seek to amend today. Tuan Speaker, it could be that these inconsistencies may be deliberate, I don‟t know, in order to make a stand to the Federal Government. Even if that is so, to push through a State bill which is inconsistent to the Federal Acts without getting a court declaration that the Federal acts have no application in our Sarawak shores lacks caution. Indeed, as it is stated in the Financial Implication at the end of the bill, the bill will involve the State Government and therefore the people of Sarawak, extra financial expenditure. Even though the amount cannot be ascertained yet, we can be sure that it would be a substantial sum.

Be that as it may, Tuan Speaker, for what it is worth, regarding the bill, we support the

spirit of the bill. We have never any issue on where our loyalty should lie.

But there is an observation which I request for this House to look into. Regarding the ex post facto law.

Tuan Speaker, since our country is following the Westminster system of government,

ex post facto laws are technically possible as the doctrine of parliamentary supremacy allows Parliament to pass any law it wishes. Along the same vein, our State Legislative Assembly should be clothed with the same power and authority to legislate that this bill should take effect retrospectively. Initially the date was to set to take effect from 1st January 2018 but has just been proposed by the Honorable Minister to be further amended to take effect from the date on which the bill is gazetted.

Tuan Speaker, my question now is this, what would happen to the years in between

22nd July 1963 until now? That is when Sarawak, the government was first established. Is the OMO 1958 practically enforceable during these years (as the provisions in there provided for as when Sarawak was still a colony of Great Britain). We all know that this ancient piece of legislation is revived with the purpose of using it as an ammunition to try to claim back our State‟s oil and gas executive rights against Petronas and the Federal Government. But the question is, is it the right ammunition? If it is, then should we be enforcing our rights against them retrospectively from 1958 till now? Imagine the sums of money we can collect from PETRONAS to improve the lives of our people. But of course, we have to note the issues raised by Honourable member for Padungan regarding scaring off oil investors and so forth.

Tuan speaker, we all stand together when it comes to reclaiming the rights of our

State. But instead of skirting around the issue, we might be wiser to take the bull by its horns and go to court to declare that the PDA, the Territorial Sea Act and the Continental Shelf Act are not applicable in Sarawak. It does seem odd to keep declaring that we have the authority to issue licenses for things where their ownership seems to have been given away long time ago.

But as I have said, for what it is worth, I support the Bill. Thank you.

Tuan Speaker: Honourable Member for Daro. YB Encik Safiee Bin Haji Ahmad: Terima kasih Tuan Speaker, kerana telah memberi peluang kepada saya untuk mengambil bahagian dalam perbahasan Rang Undang-Undang Kerajaan Oil Mining Amendment Bill, 2018. Pertama kali saya ingin ucapkan tahniah dan syabas kepada Kerajaan Negeri kerana telah mengambil inisiatif untuk membuat pindaan ke atas Oil Mining Ordinance yang tidak pernah dipindah sejak tahun 1958.

Tuan Speaker, pindaan ini adalah amat bertepatan sekali pada masa kini untuk menambahbaik undang-undang yang sedia ada selaras dengan tuntutan semasa dalam industri gas dan minyak atau pun hidrokarbon. Pindaan ini telah mengemaskini ordinan yang sedia ada untuk menjadikannya satu ordinan yang lengkap, bersifat menyeluruh serta jelas untuk dilaksana dan dikuatkuasa.

Penukaran beberapa perkataan yang tidak lagi relevan diantaranya iaitu Chief

Secretary kepada Authority Governor In Council kepada Majlis Usaha Kerajaan Negeri dan juga penukaran perkataan daripada batu persegi kepada km persegi menjadikan Ordinan ini tepat dengan terma-terma semasa.

Dengan pindaan kepada Oil Mining Ordinance, 2018, ia telah memastikan hak-hak kita

negeri Sarawak akan terus terpelihara. Hak-hak hakiki ini melalui Oil Mining Ordinance yang telah wujud sejak 60 tahun yang lalu jangan dibiarkan diambil alih oleh PDA 1974 atau mana-mana undang-undang yang bercanggah dengan undang-undang dalam negeri kita.

Sebagai anak Sarawak adalah menjadi tanggungjawab kita bersama untuk mempertahan-kan dan memperjuangkannya tanpa mengira fahaman politik.

Kita merasa amat terkilan apabila mendapati ada pihak tidak menghormati hak kita

malah sanggup membawa perkara ini ke mahkamah. Namun keputusan Mahkamah Persekutuan menolak atau menggugurkan kes ini serta keberanian barisan peguam kita mempertahankan hak Sarawak dalam kes ini telah menunjukkan satu kejayaan moral untuk kita terus mempertahankan hak-hak kita yang telah terhakis selama ini.

Tuan Speaker, tahniah saya ucapkan ke atas Kerajaan Negeri kerana telah

menubuhkan PETROS. Dengan melaksanakan pindaan kepada Oil Mining Ordinance ini akan memberi peluang kepada syarikat-syarikat tempatan negeri ini untuk terlibat sama dalam industri minyak dan gas. Sudah tiba masanya syarikat anak tempatan kita sendiri terlibat secara langsung dalam industri ini dan bukan hanya sebagai penonton. Keutamaan kepada pengeluaran lesen yang berkenaan hendaklah diberi kepada syarikat anak-anak tempatan kita. Kita perlu mempunyai keyakinan bahawa anak-anak tempatan negeri kita sediri juga mampu melakukannya.

Tuan Speaker, dengan pelaksanaan Oil Mining Ordinance ini sepenuhnya sudah pasti

akan meningkatkan sumber pendapatan kepada negeri kita. Kita tidak perlu lagi bergantung hanya kepada royalti sahaja. Dengan peningkatan pendapatan negeri ini akan digunakan untuk membawa lebih pembangunan di negeri kita khususnya pembangunan infrastruktur asas di kawasan luar bandar.

Tuan Speaker, penukaran Seksyen 31 yang menekankan pelaksanaan kajian

penyeliaan impak alam sekitar yang perlu kelulusan Lembaga Sumber Asli dan Alam Sekitar sebelum pengeluaran lesen ataupun kebenaran untuk melaksanakan kerja-kerja perlombongan dilaksanakan merupakan satu tindakan yang proaktif untuk memastikan alam sekitar di negeri kita ini terus terpelihara demi kebaikan generasi yang akan datang seterusnya membuktikan bahawa kerajaan negeri amat perihatin memelihara alam sekitar.

Tuan Speaker, pindaan ke atas ordinan ini juga memberi lebih kuasa kepada Kerajaan

Negeri dalam mengawal selia segala aktiviti perlombongan yang berkaitan dengan gas dan minyak dalam negeri kita. Dengan ini hak negeri kita dalam perkara ini akan terus terjaga dan terpelihara dari diambil kesempatan oleh mana-mana pihak termasuk pihak PETRONAS.

Dengan memasukkan bahagian baharu iaitu bahagian ke 6 dan ke 7 berkaitan dengan

kesalahan dan penalti menjadikan Ordinan ini lengkap dan jelas serta memudahkan kerja-kerja penguatkuasaan.

Tuan Speaker, bagi memastikan ordinan ini dapat dijalankan dengan berkesan, maka

penguatkuasaan hendaklah dilaksanakan dengan serius agar semua pihak akur, patuh dan menghormati undang-undang termaktub di negeri kita ini. Tidak ada gunanya kita mempunyai undang-undang yang baik dan lengkap tetapi kita tidak berupaya menguatkuasakannya.

Selain daripada itu, saya juga bersetuju dengan beberapa rakan ahli Yang Berhormat

yang lain jumlah denda dan hukuman yang telah ditetapkan mungkin boleh dikaji semula. Bukan setakat boleh didenda tidak melebihi RM200,000.00 atau dipenjara tidak melebihi lima (5) tahun atau kedua-duanya sekali tapi satu hukuman yang lebih berat perlu dikenakan kepada mana-mana pihak yang melanggar atau tidak patuh kepada Ordinan ini.

Sehubungan dengan itu, Tuan Speaker saya dengan ini menyokong Rang-Rang

Undang-Undang Kerajaan Oil Mining (Amendment) Bill, 2018.

Sekian, terima kasih. Tuan Speaker: Any other Honourable Members who wishes to speak? Member for Kota Sentosa. YB Encik Chong Chieng Jen: Thank you, Tuan Speaker for giving me this opportunity to speak, to participate in the debate on the Amendment to the Oil Mining Ordinance, 2018 (OMO).

Tuan Speaker, to start with I would like to just to state our support for the bill. Further to that I just like to add some observation and put some queries to the Minister, the Honourable Minister who has tabled this bill. My first issue on this proposed Amendment Bill is on its enforceability.

Tuan Speaker, the fate of Sarawak‟s oil and gas industry or our natural resources was

sealed on the fateful day of 24th July 1974. That was the day when the Menteri Perusahaan, the Federal Minister, Menteri Perusahaan tabled, tabled the Petroleum Development Act Bill in the Parliament, 24th July 1974 and it was none other the Honourable Minister at that time was our presence Governor.

Let me refer to the Hansard on this. Ya, Menteri Perusahaan Utama, Datuk Haji Abdul

Taib Bin Mahmud as he then was. And it was, pursuant to that Bill which was later passed in the Parliament and that all the oil and gas ownership was then vested in PETRONAS until today, until today. Let me refer this august House to Section 2 of PDA. I read it out Section 2(i) “The entire ownership in, and the exclusive rights, powers, liberties and privileges of exploring, exploiting, winning and obtaining petroleum whether onshore or offshore of Malaysia shall be vested in a Corporation to be incorporated under the Corporation Act, 1965 or under the law relating to incorporation of companies”.

Tuan Speaker, The Honourable Ministers the word used here which I would like to

emphasize and highlight to this august House is the word exclusive, exclusive rights to exploring, exploiting and obtaining petroleum. By the definition of the word exclusive that it is excludes all other parties any rights to it.

Tuan Speaker, it must be noted that, you know, the Sarawak State Government has

make a lot of attempt to try to get back the rights of oil and gas be it ownership or regulatory, power but I don‟t think we are making any headways in that aspects and by the passing of this bill today or tabling of this bill today in this House, let the people of Sarawak not be deceived that we are claiming ownership of the oil and gas. At most what you are trying to claim is the regulatory power to regulate this industry and ownership was still remains in Petronas. If I may, the Minister can confirm that as well that you are not claiming ownership back, ownership over the oil and gas of our land from the Federal Government. That is point number one. Even in respect of the purported amendment here which purports to regulate, the amendment of this bill which purport to regulate the oil and gas industry, the operation of exploration, mining of oil in our State that will run contrary to the word exclusive rights which appears in the PDA 1974 and we all know under Article 75 of our Federal Constitution which I will read out here.

Tuan Speaker, Article 75 reads,

“If any State law is inconsistent with a Federal Law, the Federal Law shall prevail and the State law shall, to the extent of the inconsistency, be void”. That is as clear as water? Not the Rajang water, Rajang River, as clear as crystal.

The word here is if any State is inconsistent with a Federal Law, the Federal Law shall

prevail. Now we have a Federal Law, a Federal Law which provides or confer upon Petronas be an exclusive rights to manage the oil and gas. Now you have another State law to try to regulate it. That is inconsistent. Unless, unless you are formulating your regulation in accordance with Petronas. At the end of the day when PETRONAS has certain policy or regulation which is inconsistent with Sarawak or the management company that was management authority, that was given the authority to regulate the oil and gas industry, the Federal law will prevail and that is what I am questioning here, I have heard all this, all our Members from GPS now, GPS although you are not registered, you are not registered so at the moment still, is it illegal? Is it illegal? Not illegal is it? There is no GPS now? Okay, a loose coalition of PBB, SUPP, PRS and PDP, okay. A loose coalition of that or unlawful coalition, is it? Never mind, Members from ex, former BN alright former BN.

Talk about this is we have got our rights now this is the right way to do it. You are

talking here as if you have been all the rights already without looking into detail of what or how to resolve this conflict of law issue. Are we just syok sendiri here in this House? There is no conflict between OMO and PDA. OMO was enacted in 1958 way before we formed Malaysia. PDA was enacted in 1974 after the formation of Malaysia. So when we formed Malaysia, we have to sit down on the negotiating table Sabah, Sarawak, Malaya, Singapore and United Kingdom. What happened to the laws that has been enacted before? And with the formation of Malaysia, what happened to these laws? Unless these laws are repealed then the new laws will come into play. That is where which has been mentioned by the Minister, Article 73. Article 73 preserve that OMO. OMO was never repealed. It was never repealed and it gives the protection, the rights to the State of Sarawak on its resources as well as the continental shelf. What belongs under the continental shelf? That‟s why there was no contradiction or conflicts. So what we are demanding down here is perfectly correct and this is what we want from Pakatan Harapan leaders from Sarawak. You must fight for this. That is only my comment. Thank you. YB Encik Chong Chieng Jen: To answer Honourable Member for Asajaya Honourable Minister. Whatever, whether it is the law OMO was passed before Malaysia or otherwise and now we have an amendment which will take effect on the date of gazette notification. Alright. And we look at the content of the act, the bill there are likely to be inconsistency. Inconsistent in terms of regulation that will be formulated by the State Authority and against the existing regulation that was formulated by PETRONAS pursuance to PDA. And in light of that inconsistency which will prevailed. It doesn‟t mean that you have the act that was passed in 1958 therefore that‟s it, you have a stronger act. No. It doesn‟t work like that. Constitutional Law doesn‟t work like that. Okay, okay, okay. Menteri Pelancongan, Kesenian, Kebudayaan, Belia dan Sukan (YB Datuk Haji Abdul Karim Rahman Hamzah): You refer to Article 73 Clause 3, any provision or any enactment that was enacted and not repealed will become more or less law. Actually it is PDA that contravenes us so if this matter would to go to court (interruption)...ya. YB Encik Chong Chieng Jen: You see… you see… you see… you, you acknowledge that PDA contravene our law right, so now that is the conflict of our law, PDA contravene our law but PDA mean a federal law were take precedence over the state law. Nevermind, nevermind that‟s why I say, that‟s why I say. Menteri Pelancongan, Kesenian, Kebudayaan, Belia dan Sukan (YB Datuk Haji Abdul Karim Rahman Hamzah): State law Article 73 Clause 3 State Law that was enacted before the formation of Malaysia will automatically can become Federal Law if it is not repealed. It is correct, at Article 73 says that if it is in the Federal it concerns the Federal matter than automatically it becomes a Federal Act but if it is State that is State Act and Kota Sentosa is correct because that Article 75, Article 75, present Federal Constitution if you have conflict in the law in the two provisions, State and Federal, Federal Constitution takes precedence. So shouldn‟t I mean for any rectification or correction to be made, you must first own out to the mistake. So can we get the mover of the bill, the PDA bill to apologize to the people of Sarawak for moving that. That Bill in Parliament on that faithful day of 26, 24th July 1974. Can we get that and then to all those who participated vote to support, all the ten BN members of Parliament to apologize and their successor in titles also must apologize first and only when you acknowledge that you are at fault, you are wrong than we were proceed from there. Is it Tuan Speaker? I will go on to the fact about whether to claim ownership or otherwise alright what we can do as a Federal Government? What we can do. We have offer you 20% oil royalty but you refused, you refused. Now…(interuptions)..you may question.. Tuan Speaker: Order, order. YB Encik Chong Chieng Jen: You may question the quantum of 20% oil royalty. You may question the quantum of 20% oil royalty but let me tell you 20% is almost all that you can earn. The nett profits that you can earn from the development of oil industry. 20% that is 3% of the gross. Tuan Speaker: Honourable Member for Kota Sentosa. You can wind up. YB Encik Chong Chieng Jen: I cannot, I have few more points, very important points. Tuan Speaker: You can wind up. YB Encik Chong Chieng Jen: Not on this part. Tuan Speaker: It is because it follows rectification and some of this have to be settled in court, does not prevent the State Government from taking this in court. YB Encik Chong Chieng Jen: I totally agree with you, Tuan Speaker. Tuan Speaker: You can wind up. YB Encik Chong Chieng Jen: That‟s why I said this is a maybe a syok sendiri Rang Undang-Undang…(laughter)... You can place all you want in this august House but at the end of the day just like what Tuan Speaker said, you can go to court to decide who has precedence over the thing the regulatory power. Now Tuan Speaker, right on the licence, fees, rents that was proposed that was proposed and that was highlighted and mentioned by the Honourable Minister when he tabled the Bill that we will get a lot of income, extra revenue from this licences. I do not know how much we can get but for the past, for the other commodities, natural commodities which we have licence fee just a fractions a small fraction of the value of the commodity. Am I right? Take for example, licence fee for our forest. Forest are timber. Our licence fee for forest are from forest is only about RM15 million for the year of 2017, disemak became RM10 million. Now permit, forest permits to fell trees, timbers. But royalty from the forest royalty that we collected for 2017 is RM340 over millions. So, what is the meet the real proceed or benefits or money that we can get other royalties from what we collect from the natural resources or the commodity? The licence fees are chicken feet and is too small if you compare to the royalties and royalty are associated with ownership. That is why we have oil royalty in which if you read the budget, it is compensation in lieu of oil rights. That is ownership, royalty we talk about ownership. Licences for regulatory and licences and the fee that we can collect are very small and almost negligible if you compare to the value of the oil extracted from our land. And don‟t be satisfied with just the licence fee that you, I don‟t know whether you are aware of that or not but I believe Honourable Minister is also in charge of Forest Department, so he should be aware of the difference between royalty and

licence fees the amount, the quantum involved, and what we are proposing here from Pakatan Rakyat is 20% royalty and that is almost as much as you can earn in oil and gas industry.

In the oil and gas royalty, 20% of royalty of the gross value of the oil extracted or gas extracted. Another one final point that I wish to highlight or maybe to put my queries forward to the Honourable Minister is about the Bills and what he had said just now.

Tuan Speaker, when tabling the Bill, the Honourable Speaker mentioned that what we

want is more Sarawakian participation, we do not want to be by-stander in the development of oil and gas in our State. That I totally agree. That is a noble intention, a noble intention, but how would it be executed? How would it be translated into actions and how would general Sarawakian would benefit from it, I have a lot of reservation because the way Barisan Nasional or ex-Barisan Nasional is carrying out their business, but it surprise me to put some question on what has been promised or mentioned in the past four years ago and I just like to get a few of the datas on what has been mentioned by the late Adenan Satem in this august House and whether what he has promised in this House has translate into concrete action.

Tuan Speaker, on 19th November 2014, in his winding up the late Adenan Satem has

said that, we have after negotiation with Petronas amongst other things he has mentioned that there will be 280 million standard cubic feet per day of natural gas to power or non-power sectors to be supplied to Sarawak for Sarawak industries. 280 million standard cubic feet per day of natural gas, these, I quoted his words. They provide us with gas to produce electricity and other purposes to the tune of 280 million standard cubic feet per day. My questions are:

i. Whether that has been done and who benefits? Who are the recipients of the 280 million cubic feet of natural gas and at what price, is it free or at a certain price?;

ii. It was also mentioned by the late Honourable Chief Minister, Adenan Satem. He said that they have agreed to allocate, “they” as in “PETRONAS”, has agreed to allocate the baseline value of RM2.1 billion worth of contract to Sarawak companies which will increase each year. RM2.1 billion is a baseline, we start from there and to be given a contract to Sarawak companies. The Sarawak companies are named Sarawak all companies, directorships, shareholders are all Sarawakian. We are no longer interested in fronting for West Malaysia company so we will be ready for that one, allocated baseline value of RM2.1 billion worth a contract to Sarawak company which will be increased each year. That statement was made in 2014. Now my question is, has that been honoured? Who are the Sarawak company that has gotten the contract from PETRONAS RM2.1 billion worth of contract and that was in 2014? How about what is the figure in 2015, 2016 and 2017? Has it been increased of the value of contract awarded by PETRONAS to Sarawak companies and who are these companies? Please name them. Tell us.;

iii. Which was mentioned by the late Datuk Patinggi Adenan Satem was that

PETRONAS will spend or they undertake to spend about the period of five years, RM420 million of capital and operating expenditures, education and technical skill training. This is the baseline again. This is the baseline figure. They spent at least RM420 million.

Tuan Speaker, these statement was made in 2014, November. So, how much has been spent by PETRONAS for the education and technical skills training for

Sarawakian? How much has been spent? How many of Sarawakian has been duly trained under this promise?; and

iv. To spend a minimum of RM50 million over five (5) years as corporate social

responsibility on community projects, emergency aids.

Environmental Programmes

State Government and penalise work together to identify suitable CSR projects. Have these projects has been implemented? So this are what we said stock taking, stock taking of what has been promised, was has been mentioned in this august House. These are very specific things and I would like the Honourable Minister to tell us how many of these promises has been fulfilled and whether Petronas are doing it so that we can have certain amount of confidence when the Honourable Minister saying that we don‟t want us to be a by stander with the passing of this law, this Bill we were have more Sarawakian participation in the oil gas industry. Such claims in this hours were not be reduced to mere rhetoric‟s.

So I hope Yang Berhormat Menteri can enlighten us or inform this House of what was

mentioned and promised by the late Adenan Satem about our participation from PETRONAS will do for Sarawak. And last but not the least, just to conclude Tuan Speaker, also on this conflict of law issue, right, and how would the State Government react if PETRONAS is just go ahead with the selling of their or contracting entering into contract with other stackholders on the exploration of our water?

Will they be caught action of just that the State Government will just enter into

negotiation after negotiation after negotiation, endless negotiation with the Federal Government, that I think we must be informed of what the State Government intends to do but by the look of it, I think even before we start, even before we start we have already given consentient.

The law, the Bill was supposed to come into force on the 1st of January 2018 even

before we have debated on this Bill. The State Government has already given consentient instead of insisting on the law coming into effect on the 1st of January 2018. He says that we will come into force after the gazette notification, after or on the date of the gazette notification, and when were the date of the gazette notification be made?

So hopefully, Honourable Minister can clear my queries but having said all that as a

Sarawakian, as usual on matters of interest for all Sarawakian, for the sake of Sarawak, the common people of Sarawak, we Pakatan Harapan will always support. And this Bill on the phase of it yes it could give some regularity rights to Sarawak Government. That will support and I stated right in the beginning we will support that but how do you address the issue of conflict of law when it comes to enforcement? With that I conclude my speech. Timbalan Ketua Menteri, Menteri Pembangunan Perindustrian dan Usahawan dan Menteri Pembangunan Bandar dan Sumber Asli II (YB Datuk Amar Haji Awang Tengah Bin Ali Hasan): Tuan Speaker, pertamanya saya ingin mengucapkan berbanyak-banyak terima kasih atas sokongan semua Ahli-ahli Yang Berhormat terhadap Rang Undang-Undang Oil Mining (Amendment), 2018. Walaupun ada yang memberi sokongan tetapi dengan beberapa reservations. Sepatutnya Rang Undang-Undang ini diberikan sokongan sepenuhnya untuk menggambarkan pendirian kita sebagai orang Sarawak dan untuk memperkuatkan lagi perjuangan kita untuk menegakkan hak dan kepentingan negeri Sarawak ini.

Saya juga amat menghargai segala cadangan dan idea-idea bernas yang telah dikemukakan semasa perbahasan ini. Seramai 13 orang Ahli Yang Berhormat telah mengambil bahagian di dalam perbahasan ini iaitu Yang Berhormat Lingga, Sadong Jaya, Jemoreng, Repok, Piasau, Demak Laut, Meradong, Padungan, Tupong, Batu Kitang, Bukit Assek, Daro dan Kota Sentosa.

Tuan Speaker, I would like to respond to the points raised by Ahli-ahli Yang Berhormat

during the debate on the Oil Mining (Amendment) Bill, 2018. A few Yang Berhormat had raised the issue pertaining to the inadequacy of penalties provided in this Amendment Bill. I do appreciate that the amount of penalty could have been higher. We do not anticipate a lot of non-compliance due to the high impact it would cause to those who breaches the OMO. However, I can assure this august House that if a real need were to arise, the necessary amendments would be made to increase the penalties.

On the issue of enforcement against existing industry players as raised by Honourable

Member for Lingga, Sadong Jaya, Daro, Padungan and a few others; who have not complied with the OMO, the Government has decided to give a grace period of up to the end of 2019 for them to comply and regularise their operations. What is important is that the Government is now taking steps to ensure that all parties takes all necessary action to align their operations within the ambits of State laws. In fact, the State Government has conducted an engagement with all industry players since 16th of May 2018 where all necessary information and direction have been given to those who are involved in the oil and gas industry.This includes Petronas.

On the concern of Honourable Member for Bukit Assek on the effect of the Territorial

Sea Act 2012, I wish to emphasize that the Territorial Sea Act do not have much effect as it deals with the question territorial waters while OMO deals with the activities of mining on land. As defined in Section 2, of the Land Code, State land extends to the continental shelf.

On the issue of why the amendments are not made retrospective in its effect, let me

remind Ahli-ahli Yang Berhormat who were concerned on this that since this amendments involve criminal penalties, Article 7 of the Federal Constitutions prohibits criminal laws to have retrospective effect. I believe most of us here are lawyers; that you fully understand what is in our constitution. Furthermore, to have retrospective laws on the non-criminal penalties provisions would unnecessarily disrupt the industry which is currently in operation.

Ahli Yang Berhormat for Kota Sentosa pointed out that the income to be obtained from

the imposition of license fees under OMO would be minimal compared to the royalties and therefore would not bring much benefit to the State. This is an extremely myopic view of the OMO. With the strengthening of our regulatory framework, the State would be in a far better bargaining position to ensure greater participation by Sarawak in the oil and gas industry. For instance, it will facilitate a higher return of investment and ownership of equity in the

industry. In MLNG3, now the State holds 25% of equity. At this juncture, I hope that the PH Government will honour their promise in their manifesto of granting at least 20% oil royalty to Sarawak.

Honourable Member for Kota Sentosa raised his concerns OMO being inconsistent

with PDA and therefore attracting the consequence under Article 75 of the Federal Constitution. With due respect to Honourable Member for Kota Sentosa, he is over simplifying the provision in Article 75. Before Article 75, comes into the picture, the question is whether Parliament has the capacity to make such Federal law in the first place. It has always been the stand taken by the State Government that due to the wordings of Item 8 (j) of the Ninth Schedule (Federal List) read against Item 2 (c) of the State List, any laws made by Parliament on development of Petroleum has to be read subject to the competency of the State Legislature to make laws on permits and licences for prospecting for mine, mining leased and certificates.

Having heard the concerns on the effect the PDA could have on the State aspirations,

especially from Ahli-ahli Yang Berhormat from Pakatan Harapan, it gives me great pleasure to anticipate that they being now in the Federal Government would take the necessary action to have the PDA amended or repealed in the coming Parliamentary sitting. And be rest assured that any initiative would receive the full backing of the State Government. We, as a true Sarawakians should work together to achieve this objective and aspirations of the people of Sarawak.

As to the information and data requested by Honorable Member for Kota Sentosa with

regards to the natural gas allocation, contracts awarded, CSR and contribution to education and technical skills training, that involves a lots of details so I will furnish you the information in writing to Ahli Yang Berhormat. Is it okay? Thank you.

Tuan Speaker, once again, I would like to thank all the Honourable Members from both

side, from both divide for supporting this Bill and I hope this consensus, I hope this is consensus will help the State in regulating the oil and gas industry in Sarawak successfully. Thank you. Tuan Speaker: Ahli-ahli Yang Berhormat, the question before the Dewan is that the Motion standing in the Order Paper in the name of Honorable Deputy Chief Minister, Minister for Industrial Development and Entrepreneur Development and Second Minister for Urban Development and Natural Resources be referred to the Committee of the whole House. The amendments are as follows:

(a) Deleting the comma and the words and shall be deemed to have come into force on 1st of January 2018 in line 2 and 3 of the Clause 1; and

(b) Substituting the word oil in line 5 of the definition of petroleum of Clause 2(i) with the words mineral oil or relative hydrocarbon and nature gas. The consequence of the amendment to Clause 1 could result in this amendment coming into force on the date it is gazetted while the amendment to Clause 2(i) is to ensure consistency in the terms used in that definition.

Tuan Speaker: Ahli-ahli Yang Berhormat, I had received a motion dated 26th June 2018 from the Honourable Member for Pelawan. I hereby invite the Honourable Member for Pelawan to read out his motion.

MOTION 1

YB Encik David Wong Kee Woan: Thank you, Tuan Speaker. AND WHEREAS land ownership is more than a symbol of wealth, it manifaceted as one‟s fundamental and constitutional rights. AND WHEREAS we have paid for our land once already and there should not be any reason why we should pay a second or third time when the land leases expired. AND WHEREAS a Government has giving ten (10) of thousands of hectares of land at low premium to the rich corporations over the past decades and yet cannot find it in their heart to give peace of mind to our ordinary citizens over four (4) points land for their home or agriculture land to earn a living. AND WHEREAS as of December 2005, 171,157 land titles with term 60 years or less had been issued in Sarawak. The total number of land titles which will be expire by 2020 is 21,091; and by 2025 another 86,648 land titles will expire. AND WHEREAS the issue of land ownership transcends political and racial boundaries. The GPS Government should do something about it and show Sarawakians that it is indeed different from it predecessor, BN. THEREFORE it is moved that this House hereby resolved that:

(1) The Land Code be amended so that gives automatic and unconditional renewal of land leases, free of charge, to all the residential properties upon their expiry.

(2) The Land Code be amended so that gives automatic and unconditional renewal of land leases, free of charge, to all the agricultural properties containing 100 acres or less upon their expiry.

Thank you. Tuan Speaker: Ahli-ahli Yang Berhormat, this motion seeks to amend the Land Code so that it gives automatic and unconditional renewal of land leases, free of charge, to all the residential properties upon their expiry and to gives automatic and unconditional renewal of land leases, free of charge, to all the agricultural properties containing 100 acres or less upon their expiry. This motion therefore violates Standing Order 23 (4)(c) which reads:

“A motion seeking the remission of duties payable by any person; or shall not be

proceeded with, unless the recommendation of the State Government thereto is signified in writing by the Minister charged with the responsibility for finance.”

Standing Order 23 is not an avenue to amend a legislation. To propose an amendment to the Land Code is outside the ambit and purview of Standing Order 23, thereby nullifying the motion. Any proposal to amend a legislation should be done under Standing Order 45(1) and to be listed under the Order of Business pursuant to Standing Order 11. Erskine May Parliamentary Practice 24th Edition page 340 paragraphs 3, lines 14 to 16 reads:

“It is a general rule applicable to all substantive motions for the adjournment that the subject to be discussed must not involve legislation”

Standing Order 32(11) reads:

“If the Speaker is of the opinion that any motion or amendment or the continuance of the debate thereon is calculated to give rise to breaches of this Standing Order, he may disallow the motion or amendment or, as the case may be, may terminate the debate and direct that no further proceedings shall be taken on the motion or amendment.”

MOTION 2

YB Encik David Wong Kee Woan: Thank you, Tuan Speaker. WHEREAS all this while the concession of set road maintainance were awarded to only one company, which is CMS Road Sdn Bhd and the contract will end in 2018. AND WHEREAS CMS Road Sdn Bhd has been maintaining State roads in Sarawak for 15 years, and the ceiling contract sum to maintain all state roads in the State is around RM11 million per month. AND WHEREAS the maintainance work of the State roads in Sarawak has always been criticised by many road uses as less than desirable. AND WHEREAS open tender to improve the services our service providers as well as more efficient in terms of cost and delivery will give opportunities to more Sarawak companies to compete freely. AND WHEREAS the GPS Government should show Sarawakian that it is indeed different from his predecessor (BN). THEREFORE it is moved that this House hereby resolves that;

1) The State Government to stop giving out road maintenance concession to a single company.

2) The State Goverment will award the concessions for State road maintainance in open tender format.

3) The State Government is to divide the State road to ten (10) zones/packages from Southern Sarawak to Nothern Sarawak so as to be able to compare the efficiency of service providers and improve the delivery system of the State Government.

Thank you. Tuan Speaker: Ahli-ahli Yang Berhormat, I have received a memorandum dated 15th July 2018 from Kementerian Pembangunan Infrastruktur dan Pengangkutan which gives a clear and lucid explanation on the subject matter. The letter reads ‟18.7% of all States road are maintained by CMS Roads Sdn Bhd (CMSR) of the 30,524 kilometers of State roads of various categories, only 5,713 kilometers are maintained by CMSR. The rest are maintained directly by Jabatan Kerja Raya (JKR) Sarawak, Pihak Berkuasa Tempatan (PBT) and others. Therefore, the complaints, criticism made by the road users may not necessarily involved roads maintained by CMSR.

The JKR had also reviewed CMSR performance under the Performance Based Contract (PBC) and found that they had fulfilled their obligations to maintain and sustain the contracted roads not only in the same but also increasingly better condition as indicated by the measured performance indicator Road Maintainance Index (RMI) which has been steadily increasing, (60.5 in 2003 to 84.8 in 2017 for paved roads and 36.3 in 2003 to 67.9 in 2017 for unpaved roads). JKR Sarawak has carried out a supplier of CMSR to access the capacity in providing road management and maintain services under PBC to ascertain their strength in terms of resources and competencies and to gauge gaps in the capability and efficiency.

The supplier audit concluded that CMSR has the capacity, resources, competencies

and strength in many aspects that outweight the capability and efficiency gaps and they are capable of providing the services satisfactorily. The State Government has given CMSR a one-year extension until 30th June 2019 to allow the Government to carry out a review. This motion infringes Standing Order 20(2)(c) which reads,

“Without prejudice to paragraph (1), every question shall not contain any argument, inference, opinion, imputation, epithet or misleading, ironical or offensive expression.”

To allow this motion to proceed not only in violation of Standing Order 20(2)(c) but may also transgress Standing Order 24(4) and Standing Order 32(12). Standing Order 24(4) reads,

“If the Speaker is of the opinion that any notice received by the Secretary infringes any Standing Order or is otherwise out of order, he may direct –

(a) that it be printed with such alterations as he may direct; or (b) that it be returned to the member who signed it as being in his opinion out of

order.” Standing Order 32(12) reads,

“Any member who makes any statement in the Dewan that deliberately misleads

the Dewan is deemed to be out of order or to be in contempt.”

Erskine May Parliamentary Practice, Twenty-fourth Edition, page 62 reads,

MOTION 3 YB DR TING TIONG CHOON: Thank you Tuan Speaker, it is a private members motion under Standing 23. I would like to move; AND WHEREAS, Sarawak is a free market economy in which the price for goods and services are determined by the open market which is ideally should be free from any interventions by a Government, price-setting monopoly or other authorities; WHEREAS, cement supply in Sarawak is solely and strictly monopolized by CMS Cement Sdn Bhd. AND WHEREAS, the energy cost account for 40 to 50% of the total production cost of cement, for which Sarawak has abundant supplies of cheap energy; WHEREAS, in a drafted report provided to Malaysia Competition Commision in 2017 it says “Sarawak record and continue to maintain its highest price of RM21.30 per bag since June 2016 which is 10% to 15% higher than Peninsular Malaysia. On the other hand, Sabah registered the lowest price of RM17.30 since June 2016.” AND THAT monopoly of cement supplies market in Sarawak has resulted in higher cement prices and at times out of supply resulting in significant higher cost in housing and infrastructure construction in Sarawak. THEREFORE, it this moved that this house hereby resolves that:

i. The restriction to cement supplies in Sarawak to be removed; ii. To open the cement supply market in Sarawak; and iii. To set a maximum pricing of cement supply for all regions in Sarawak.

I had received a Memorandum dated 4th July 2018 from the Kementerian Pembangunan Perindustrian dan Usahawan. The memorandum reads:

In short, Honourable Member for Kota Sentosa, the letter from the Ministry is under

your portfolio. My office can extend to you the reference number and for you to take it up with your Ministry on the authenticity and veracity. The said communication reads:

“Cement is a product administered under the Control of Supplies Act 1961 which is under the purview of the Ministry of Domestic Trade, Co-operatives and Consumerism (KPDNKK). Any issues regarding monopoly of cement or any other products will be administered under the Competition Act 2010 which is also under KPDNKK.”

On 1st December 2016, the issuance of export licences approve permit (AP) for clinker

and cement was transferred from MITI to KPDNKK meanwhile import of cement requires a certificates approval (COA) from CIDB after KPDNKK is used no objection letter on the imposition of cement because the federal ministry and department, they speak in abbreviated language so I have to quote. So I have all this information in short it is a Federal matter.

This is further endorsed and enforced by a letter dated 3rd July 2018 from Kementerian Perdagangan dalam Negeri, Koperasi dan Kepenggunaan Sarawak which to the same effect so it is Federal matter. It is manifestly clear that the Motion transgresses Standing Order 24(4) and Standing Order 32 (12). The Standing Order 24(4) reads:

“If the Speaker is of the opinion that any notice received by the Secretary infringes at any Standing Orders or is otherwise out of order, he may direct that it be written.”

The Standing Order 32 (12) reads:

“There must be no misleading statement Erskine May parliamentary practice 24th Edition, page 62 read, The Speaker may ensure all these. The same as I said before, the Motion is therefore dismissed.”

Ahli-ahli Yang Berhormat, I had received a Motion dated 28th June 2018 from the

Honourable Member for Pujut. I shall call upon the Honourable Member for Pujut to read out his Motion.

MOTION 4

YB Dr. Ting Tiong Choon: Thank you, Tuan Speaker. This is definitely a Sarawak matter. WHEREAS, all Members in this chamber are elected by voters in Sarawak and each members is responsible to serve the constituency fairly and equitably; WHEREAS, in previous State Barisan Nasional Government only representatives from the governing parties were provided funds while the representatives from the State opposition party were receiving no funding at all; WHEREAS, the newly elected Pakatan Harapan Federal Government has allocated annual funds for all 222 elected representative in Parliament because Pakatan Harapan Government believe that all elected representative shall be treated fairly to serve the public adequately.

WHEREAS, on 18th May 2018, the Chief Minister of Sarawak has promised to provide annual funding of RM6.25 million to all the 19 opposition parliamentarians. WHEREAS, the newly founded GPS Government shall cease to punish the voters who have elected an opposition as their representative by unfairly starving the funding for these constituency. AND THAT providing funding to all elected representative in Sarawak would indicate this GPS Government is sincere to serve all Sarawakian without favour and has transformed from the previous Barisan Nasional regime. THEREFORE, it is moved that this House hereby resolve that;

1) The Sarawak Government to provide fair and equitable funding for all elected representative to serve their constituency in Sarawak.

2) The Sarawak Government provide fair and equitable funding for each of the 82 elected representatives services centre.

Thank you, Tuan Speaker. Tuan Speaker: This motion cannot proceed because it fails to comply with Standing Order 23(5) which reads:

“A motion which, directly or indirectly, involves any such grant, charge, expenditure, release, remission or compensation as is mentioned in paragraph (4)(a) to (d) shall be treated as seeking grant, charge, expenditure, release, remission or compensation, unless the said Minister signifies in writing that it does not go beyond what is incidental only and not of a substantial nature having regard to the purposes of the motion.”

This motion contravenes Standing Order 23(3)(a) of the Dewan Undangan Negeri

Sarawak; Standing Order 26(2)(a) and Standing Order 26(3) of the Dewan Rakyat Malaysia.

Standing Order 23(3)(a) reads:–

Standing Order 26(2)(a) of the Dewan Rakyat reads:

“A motion seeking a grant, charge or expenditure of public money”; and

Standing Order 26(3) of the Dewan Rakyat reads:–

“A motion which, directly or indirectly, involves any such grant, charge, expenditure, release, remission or compensation as is mentioned in sub-paragraphs (a) to (d) of paragraph (2) shall be treated as seeking the grant, charge, expenditure, release, remission or compensation unless the said Minister signifies that it does not go beyond what is incidental only and not of a substantial nature having regard to the purpose of the motion.”

This motion if allowed will give rise to the breaching of Standing Order 32(11). The motion is dismissed.
