1. HSBC Bank Malaysia Berhad (Company No. 127776-V) is referred to as “HSBC Bank” and HSBC Amanah Malaysia Berhad (Company No. 807705-X) is referred to “HSBC Amanah”, both collectively referred to as “HSBC”. HSBC Bank Credit Card and HSBC Amanah Credit Card-i are collectively referred to as “HSBC Credit Card(s)”.

THE PROMOTION PERIOD

2. The Promotion comprises of the Sign Up Period which runs from 1 September 2017 to 31 December 2017, both dates inclusive and is defined as the period when a customer applies for a primary HSBC Visa Signature Credit Card (“Participating HSBC Credit Card”) (hereinafter referred to as the “Promotion Period”).

ELIGIBILITY

3. This Promotion is open to any individual who is a Malaysian resident who, during the Promotion Period: a) does not hold any principal HSBC Credit Card (“New Primary Eligible Customer”); or b) is an existing principal HSBC Credit Card holder BUT does not hold a Participating HSBC Credit Card (“Existing Primary Eligible Cardholder”)

EXCEPT for the following categories of persons:

a. Cardholder(s) of invalid or cancelled HSBC Credit Card(s) within three (3) months before the date of application and is applying or re-applying for the Participating HSBC Credit Card under this Promotion;

b. Cardholder(s) of invalid or cancelled HSBC Credit Card(s) and/or whose accounts are delinquent within HSBC’s definition at any time during the Promotion Period;

c. Cardholder(s) of company and/or corporate HSBC Bank Credit Cards; and d. Cardholder(s) who have participated or are participating in any other concurrent credit card sign-

up promotions by HSBC.

4. Existing Primary Eligible Cardholders will be eligible for a different acquisition offer than New Primary Eligible Customers, as stated below.

5. For the avoidance of doubt, existing Participating HSBC Credit Cardholders are not eligible to participate in this Promotion.

(collectively, the “Eligible Cardholders”). PARTICIPATION CRITERIA

6. During the Promotion Period, Eligible Cardholders must apply for the Participating HSBC Credit Card through HSBC mobile sales team, telesales, branch or website. Once approved, Eligible Cardholders must: a. Activate the newly approved Participating HSBC Credit Card according to the activation steps in the

welcome letter; and b. Swipe and pay with the Participating HSBC Credit Card for the first three (3) purchases/transactions

with a minimum spend of RM50 for each purchase/transaction by the end of the following month from the date of the welcome letter of the Participating HSBC Credit Card (“Initial Spending”).

ACQUISITION OFFER

7. Upon satisfying each step of the Participation Criteria in Clause 6 above, Eligible Cardholders stand to receive Reward Points, as stated in the table immediately below, per Eligible Cardholder, on a first-come, first served basis and subject to availability.

Note: If a customer’s welcome letter is dated 5 September 2017, he/she will have till 31 October 2017 to fulfil the above criteria.

8. The Reward Points under this Promotion will lapse, and the Eligible Cardholder will no longer be eligible

to earn it, if an Eligible Cardholder does not fulfil the criteria stated in the table immediately above.

9. For the avoidance of doubt, the maximum Reward Points an Eligible New Primary HSBC Customer stand to receive is 100,000 points while an Existing Primary HSBC Cardholder will only receive 30,000 under this Promotion.

10. The total Reward Points available for this Promotion is capped at 430 million Reward Points only on first-come, first-served basis.

11. The Initial Spending are purchases/transaction that are charged to the Eligible Cardholder’s

Participating HSBC Credit Card by the end of the following month from the date of welcome letter and: a. Includes: local and overseas retail transactions (including online transactions), and: b. Excludes: Cash Advance, standing instructions/non-online auto-billing, balance transfer (BT), cash instalment plans (CIP), interest charges, finance charges/management fees, credit card annual fee and the goods and services tax on the annual fee;

(collectively, “Eligible Spend”).

12. At the time when the Reward Points are to be credited to the Eligible Cardholder’s Participating HSBC Credit Card account, the card account MUST NOT be delinquent, and/or invalid or cancelled within HSBC Bank’s definition, otherwise the Reward Point will be forfeited.

13. If any Eligible Spend is disputed or alleged to be fraudulent within or after the Promotion Period but

before the Reward Points is credited to an Eligible Cardholder, the Eligible Cardholder shall be disqualified from receiving the Reward Points under this Promotion.

14. The Reward Points will be credited into the Eligible Cardholders’ Participating HSBC Credit Card account within 60 days after the end of the Promotion and will be reflected in the Eligible Cardholder’s Participating HSBC Credit Card statement following the credit.

15. The Reward Points earned cannot be exchanged for cash or credit.

16. HSBC Bank will not entertain requests to credit the Reward Points into any other HSBC credit card account; exchange or substitute the Reward Points with any item, nor are Eligible Cardholders allowed to transfer or sell their Reward Points to any person.

17. HSBC Bank shall not be held liable for any mishaps, injuries or accidents that may occur in the

redemption with the Reward Points awarded under this Promotion.

18. The Reward Points, once awarded, are valid for a period of three (3) years and must be redeemed prior to their expiry as stated in the Eligible Cardholder’s HSBC Visa Signature Credit Card monthly statement. HSBC Bank will not entertain any request by the Eligible Cardholder or any other person for an extension of the validity of the Reward Points.

GENERAL TERMS & CONDITIONS

19. HSBC Bank reserves the right to substitute the Reward Points with any other prize or item of similar value at any time with three (3) days prior notice.

20. HSBC Bank reserves the right to publish or display the name, picture and city of residence of the Eligible Cardholders who receive the Reward Points under this Promotion for advertising and publicity purposes. The Eligible Cardholders hereby consent to and agree that HSBC Bank shall be at liberty to publish their names, pictures and city of residence without compensation for advertising and publicity purposes.

21. HSBC Bank reserves the right at its absolute discretion to vary, delete or add to any of these Terms & Conditions with three (3) days prior notice and such amended terms and conditions shall prevail over any provisions or representations contained in any other promotional materials advertising in this Promotion.

22. HSBC Bank reserves the right to cancel, terminate or suspend this Promotion with three (3) days prior notice. For the avoidance of doubt, cancellation, termination or suspension by HSBC Bank of this Promotion shall not entitle the Eligible Cardholders to any claim or compensation against HSBC Bank for any and all losses or damage suffered or incurred by the Eligible Cardholders as a direct or indirect result of the act of cancellation, termination or suspension.

23. In no event will HSBC Bank be liable for any losses or damages (including without limitation, loss of income, profit or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with this Promotion, even if HSBC Bank has been advised of the possibility of such damages in advance, and all such damages are expressly excluded.

24. To the fullest extent permitted by law, HSBC Bank expressly excludes and disclaims any representations, warranties, or endorsements, express or implied, written or oral, including but not limited to, any warranty of quality, merchantability or fitness for a particular purpose in respect of this Promotion.

25. HSBC Bank may use any of the following modes to communicate notices in relation to this Promotion to the Eligible Cardholders: (i) individual notice to the Eligible Cardholder (whether by written notice or via electronic means)

sent to the Eligible Cardholder’s latest address/email address as maintained in the HSBC Bank’s records;

(ii) press advertisements; (iii) notice in the Eligible Cardholder’s composite statement(s);

(iv) display at its business premises; or (v) notice on HSBC Bank’s internet website; where such notices shall be deemed to be effective on and from the 4th day after its delivery / publication / display as per the manner described herein. Save and except notices sent via ordinary mail which will be deemed delivered on the 3rd day after posting, notices sent via other modes as described herein are deemed delivered immediately after posting/publication/display.

26. These Terms and Conditions are in addition to the existing respective terms and conditions which regulate the provision of the products and propositions referred to in this Promotion. The existing terms and conditions applicable to the products and propositions referred to in this Promotion are available at www.hsbc.com.my. They are:

I. Universal Terms & Conditions of HSBC Bank: (i) Generic Terms & Conditions; and

(ii) Cardholder Agreement; II. HSBC Visa Signature Credit Card Programme 2017/2018; and

III. Terms and Conditions for HSBC Rewards Programme August 2017 Edition. In the event of inconsistency between this Promotion’s Terms and Conditions and the existing respective product and proposition terms and conditions, these terms and conditions shall prevail in relation to this Promotion.

27. HSBC Bank shall not be liable for any default due to any act of God, war, riot, strike, terrorism, epidemic,

lockout, industrial action, fire, flood, drought, storm or any event beyond the reasonable control of HSBC Bank.

28. HSBC Bank’s decision on all matters relating to this Promotion and in case of any dispute will be final

and binding on all Eligible Cardholders of this Promotion and no correspondence will be entertained.

29. Eligible Cardholders shall be personally responsible for all applicable government taxes or levies relating to the privileges/benefits and/or the Promotion (if applicable).

30. By participating in this Promotion, the Eligible Cardholder agrees to be bound by these Terms and Conditions and the decisions of HSBC Bank.
