Earnest Money• It shall be a condition of this tender that the Contractor shall submit an

Earnest Money of RM 5,000.00 together with his tender submission,failing which his tender will be disqualified.

• Earnest Money shall be in the approved form of Banker's Guaranteeattached herein or Bank Draft from approved Banks operating in Malaysia.Company cheque and Insurance Guarantee will not be accepted.

• If the Contractor shall:-• 1. withdraw his offer after he has been awarded the tender, and/or

2. withdraw his tender before the expiry of the Tender Validity Periodthen in any of such event(s), the Employer shall without prejudice to hisany other rights that he may possess, forfeit the Earnest Money.

• The Earnest Money shall be returned to all unsuccessful Contractors uponaward of the tender. The Earnest Money of the successful Contractor shallonly be returned after the submission of the Performance Bond.

Performance Bond

• The Contractor shall provide Performance Bond Guarantee from abank operating in Malaysia, to the Employer in a sum equal to five(5%) percent of the Contract Sum, for the due observance and dueperformance of the Contract under the terms of the Bond. Thebank and the terms of the Bond shall be such as shall be approvedby the Employer, and the cost of obtaining the Bond shall be at theexpense of the Contractor and shall be included in the ContractSum. The original of the Bond shall be deposited with the Employeras a condition precedent to the commencement of the Works, andshall remain with the Employer and be valid for the full duration ofthe Contract or the last delivery/shipment/consignment of theGoods whichever is the later, and in the case of the Contract beingdetermined, one calendar year after the date of the determination.

• Insurances cover for accidental bodily injury : Refer to insurance policies that has been taken up by to or illness of third parties (whether fatal the Employeror not), accidental loss of or damage toproperty belonging to third parties (the aggregate liability of the insurers shall be limited by twice the limit of indemnity causedby any one occurrence

• Insurance deductible amount : Refer to insurance policies that has been taken up by the Employer

• Percentage to Cover Professional fees : Refer to insurance policies for reinstatement that has been taken up by the Employer

• Amount for removal of Debris : Refer to insurance policies that has been taken up by the Employer

• Value of existing structure together with : Not applicableall the contents owned by the Employer or for which he is responsible

• Liquidated and Ascertained Damages : At the rate of RM 700.00 per day

• Period of Honouring of Certificates : Thirty (30) days from the date of the Certificate
